Every year the site must be notified by June ls` PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: 1. 15A NCAC 13B .1406 An operator shall be on duty at the site at all times while the facility is open for public use to ensure compliance with operational requirements and access to such facilities shall be controlled. The gate was wide open, not locked, as it is supposed to be without an attendant on duty. 2. 15A NCAC 13B .1404 (a) If there are Edge of Waste markers, marking the 50 foot buffer from a property line, they are not easily visible and within line of sight. T posts were observed with painted tops, but it could not be distinguished as being a property line marker or edge of waste marker. There appears to be a windrow of yard waste within 25 feet of the property line. This material must be moved to be out of the 50 foot buffer from property lines. This has been commented on in the maiority of the previous inspection reports. 3. 15A NCAC 13B .1402 (f) Solid waste compost facilities shall be classified based on the types and amounts of materials to be composted. (1) Type 1 facilities may receive yard and garden waste, silvicultural waste, untreated and unpainted wood waste or any combination thereof. There was a lot of unacceptable waste in with the debris. Remove all unacceptable waste on a frequent basis. It appears that the street sweeper is still dumping the street sweepings on the ground. They cannot do that, that is why the dumpster was put at the site. The street sweeper is to dump directly into the dumpster or however it can be decided, as long as it does not dump the sweepings on the ground. These issues have been commented on all reports since 2012. 4. 15A NCAC 13B .1406 (3) Surface water shall be diverted from the operational, compost curing, and storage areas. The site must be graded to prevent ponding of water and there is to be no waste in water. There were many areas of standing water and waste in water at the site. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The comments in this report have been made over and over, for the past 5 years. Compliance action will be taken if the site is not brought into compliance within 45 days of receipt of this report. 2. A 25-foot minimum distance is required around the site as well as between compost areas and swales or berms to allow for adequate access of firefighting equipment. 3. A 50-foot minimum buffer for debris is required from all property lines. There was a windrow of yard waste which appeared to be within 25 feet of the property line. 4. There appeared to be an area where driller's mud has been off loaded. Driller's mud cannot be put at the Yard Waste site. This material must be removed from the site and brought to an approved disposal site. 5. There were scattered piles of yard waste around the site. The waste is to be kept in windrows. 6. Piles of broken up concrete were observed. If this material is being used as beneficial fill to build up the area, then it should be put in the place to be built up. Concrete is not an acceptable item for a Yard Waste Notification. 7. Your application for this Yard Waste Notification states for Number 11- Describe the composting process to be used: "Windrow composting is placed in long windrows and the material is turned periodically to accelerate the composting process and provide uniform compost. An open space is left between each windrow to allow room for turning equipment. Leaves are placed in windrows, temperatures are monitored constantly and turned as often as needed. If additional processing is done, it is done by tub grinders." You stated in Number 12- Describe the mulching process to be used: "Mulching is done by tub grinder, the end results are sold as boiler fuel to local plants." If the end product is to be sold/given to the public, temperatures must be monitored and logged. If the material is going for boiler fuel, that would mean that you are going to grind the material. It also stated on the application for the Yard Waste notification that 6000 cubic yards would be coming in each quarter and 6000 cubic yards would be removed each quarter. It does not appear that any material has been removed. What are the actual plans for processing this material and getting the material off site??
