PO Box 12 West End, NC 27376 allan@kkcubuilders.com allan@casavantgroup.com PARTICIPANTS: David Powell, NC DEQ – Solid Waste Section Amanda Thompson, NC DEQ – Solid Waste Section STATUS OF PERMIT: Expired September 16, 2018 PURPOSE OF SITE VISIT: Complaint Inspection/Follow Up STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0566 (7): Unresolved - This rule has been readopted in 2021 and has changed is now combined into (3), (4), and (5). (3) All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. (4) Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community. (5) erosion control measures, structures, or devices shall be utilized to prevent silt from leaving the site and to prevent on-site erosion, and shall comply with 15A NCAC 04. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 Permit to operate Attachment 3, cover material requirements #21 states, “Within 120 calendar days after completion of the final disposal operations, the disposal area must be closed and covered with a minimum of one (1) foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. However, for ditches located on the landfill, at least 2 feet of soil cover is required between the bottom elevation of the ditches and the waste mass.” 15A NCAC 13B 0.0564 (9): Unresolved – This rule has been readopted in 2021 and is now (6) Buffer Requirements: A site shall maintain the following buffer requirements:(a) 50 feet from the waste boundary to waters of the State as defined in G.S. 143-212. (b) 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells. Mobile homes on right of photo view are still in same location. OBSERVED VIOLATIONS: 1. Section staff observed about 70 dump truck loads of mixed soil with asphalt (about 85% is soil) which had been brought and dumped inside of edge of waste (EOW) onto LCID that is not permitted to operate at this time. Personal belongings, equipment and vehicles also seemed to be stored inside the EOW along access on NE corner of the LF. Section staff communicated with Steve Arrington, with Fred Smith Company, and he confirmed bringing the estimated 70 loads to the LCIDLF and dumping them. He indicated the Alex Helton accepted the waste for road repair. 15A NCAC 13B .0201 (a) - No person shall treat, process, store, or dispose of solid waste or arrange for the treatment, processing, storage, or disposal of solid waste except at a solid waste management facility permitted by the Division for such activity, except as provided in G.S. 130A-294(b). (b) No person shall cause, suffer, allow, or permit the treatment, storage, processing, or disposal of solid waste upon any real or personal property owned, operated, leased, or in any way controlled by that person without obtaining a permit for a solid waste management facility from the Division authorizing such activity, except as provided in G.S. 130A-294(b). (c) No solid waste management facility shall be established, operated, maintained, constructed, expanded, or modified without a valid permit issued by the Division for the specified type of activity. It is the responsibility of every owner or operator of a proposed solid waste management facility to apply for a FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 6 permit for the facility. The term "owner" shall include record owners of the land where the facility is located or proposed to be located and holders of any leasehold interest, however denominated, in any part of the land or structures where the facility is located or proposed to be located. NE corner of LCID. Soil/asphalt, equipment and belongings also stored inside EOW. ADDITIONAL COMMENTS 1. Purpose of inspection was to investigate a complaint received day before about landfill operating again and follow up on closure. This landfill is not permitted to accept any waste due to an expired permit in 2018. CEASE ACCEPTING WASTE. Remove all equipment and vehicles from inside the EOW and stop operating on top the LCID other than corrective actions. Two options for compliance were offered: Remove all soil/asphalt mix to appropriate landfill or screen out asphalt and use soil for cover and the asphalt will go to appropriate landfill or be recycled. A 30-day time frame was given and documentation of either option is needed to be sent to Section staff David Powell. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 6 2. The permit for the Stump Hole LCID landfill expired in September of 2018. Allan Casavant, owner, decided to begin closure process at the landfill instead of applying for a permit renewal. There has been recent communication with Mr. Casavant about submitting the completed final paperwork for closure but it has yet to be submitted. Please do so ASAP. 3. Be sure and remove unapproved wastes, such as plastic bags and rubber mud flaps from dump truck and dispose at appropriate landfill. 4. Some areas have eroded, although soil has been added for cover. Some exposed waste still exists. Vegetative ground cover sufficient to restrain erosion shall be established at this facility. Some vegetation need mowing. This is important to resolve previous violations. Cut trees that are growing on side slope next to roadway. Owner should communicate again with the Sections Permit Engineer, Ming Chao, for Moore County, to ensure all requirements that are needed for closure. Owner should communicate with County Planning and Zoning for any permits or actions they may require. Also, DEMLR should be contacted in regards to any mining, sedimentation and erosion control and storm water requirements. 6. EOW markers should be fixed to meet rule. Permit Condition No. 10, Part 1 of Attachment 3 of the Permit to Operated dated September 16, 2013 (DIN 18927) - The permanent markers that accurately delineate the waste disposal boundary must be maintained. 7. The Section has not received the require documentation to close the site. Once the property is sold, then new owner can apply for a permit at that time, but the site must be properly closed and in compliance per the rules before submitting a new application for permit. Please bring this site into compliance and submit required closure documentation. 8. Corrective measures are necessary to bring the landfill into compliance and should be completed within 30 day’s receipt of this inspection report. The trailer/residence needs to be moved to become complaint with buffer rules. Requested final closure documents need to be submitted to Section Permitting. All soil/asphalt waste should be removed or have the asphalt separated from the soil and use the soil for cover. Provide documentation or photos for asphalt being removed either to an appropriate landfill or recycling process. Better cover with establishing vegetation once cover is added. EOW markers repaired and installed in correct locations. Submit final closure documentation.
