Every year the site must be notified by June ls` PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: 1. 15A NCAC 13B .1406 An operator shall be on duty at the site at all times while the facility is open for public use to ensure compliance with operational requirements and access to such facilities shall be controlled. The gate was wide open, not locked, as it is supposed to be without an attendant on duty. The gate being left open has been stated on most of the previous reports. T posts were observed with painted toes. but it could not be distinguished as being a property line marker or edge of waste marker. There was a T- post (with painted top) within 50 feet of the canal- what is its purpose, as all waste is to be kept a minimum of 50 feet from surface water. This has been commented on in the last several reports. 3. 15A NCAC 1313.1406 (3) Surface water shall be diverted from the operational, compost curing, and storage areas. The site must be graded to prevent ponding of water and there is to be no waste in water. There were many areas of standing water and waste in water at the site. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. There appeared to be an area where driller's mud has been off loaded. Driller's mud cannot be put at the Yard Waste site. This material must be removed from the site and brought to an approved disposal site. 2. There was some unacceptable waste in with the debris. Remove all unacceptable waste. The amount of unacceptable debris is much less than usual, so good job, but, make sure there is no unacceptable debris. This has been commented on, on most every previous inspection report 3. This yard waste site appears not to have been used recently. There are tall grasses and weeds growing up over the site. 4. A 25-foot minimum distance is required around the site as well as between compost areas and swales or berms to allow for adequate access of firefighting equipment. 5. A 50-foot minimum buffer for debris is required from all property lines. Please contact me if you have any questions or concerns regarding this inspection report.
