Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Section staff Drew Hammonds and David Powell met with Oryan Lowry, Town Administrator, and Andy Coleman, Public Works, at the Town of Bladenboro Yard Waste Notification (YWN) for inspection. YWN is behind the wastewater treatment plant. 2. A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Mr. Powell emailed 15A NCAC 13B .1401 - .1408 rules for Mr. Lowry for review via email on 5/19/2021. 3. Some waste is outside of approved area up near entrance at fence. All yard waste should be inside the original approved 2-acre area. 4. Edge of waste (EOW) markers are needed for the 4 corners of the 2-acre notification. This will help inspector see edge of waste and onsite staff to know the limits of operations for the notification. Suggest tall, white PVC pipe. 5. There was a fair amount of unapproved waste comingled through the yard waste onsite. Plastic, entire trash bags filled with misc. wastes, parts of furniture like couch cushions, block, brick, dimensional lumber etc. Be sure and remove and dispose at a landfill for that waste type. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 6. Onsite discussions included that there is a good amount of YW that needs removal or processing. Material needs to be separated into windrows for fire control and access for firefighting equipment if it would be needed or just be removed for disposal to the appropriate landfill. While onsite Mr. Lowry discussed that funding was available for addressing some of these issues and the site would be fixed. Currently we are at the beginning of June 2021 and that makes things difficult with end of year and starting of a new one with local governments. Either way we need to fix these issues as quickly and correctly as possible. Communicate with David Powell on progress. 7. Renewal is due by June 1, each year and should indicate current operations the town is dong with YWN. Mr. Lowry submitted 2020 and 2021 renewal application after inspection. Good job. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 4 8. Currently, a sign at the entrance is required according to 15A NCAC 13B .1406 (9). 9. Discussions of a new Temporary Disaster Debris Site (TDDS) were discussed and later a site was visited, near ballfield, in which Mr. Lowry would potentially like to have an approved site. Mr. Powell later emailed a link to the TDDS and YWN information on the Sections webpage. 10. Before leaving Charles Peterson, Bladen County Commissioner and Russell Hickman, General Contractor arrived to discuss IS092105. Staff then left YWN and visited the IS site. 11. Corrective measures are necessary as result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff in about 30 days. Failure to meet the conditions for compliance may result in Compliance Actions. Mr. Powell is willing to work with the Town of Bladenboro moving forward, just please communicate well and make progress towards fixing the issues onsite quickly.
