15A NCAC 1311.1406 OPERATIONAL REQUIREMENTS FOR SOLID WASTE COMPOST FACILITIES
(14)(A) The finished compost shall meet the classification and distribution requirements outlined in Rule .1407 of this Section.
The Tarboro YW facility is in violation of this rule in that yard waste has been dumped haphazardly on many areas of the site for
many years with no management. In order for the Tarboro yard waste facility to be brought into compliance, move the yard waste
that has been dumped in various areas on the site to the desienated vard waste area and manaee as needed. Locate an end user for
the compost and remove.

(C)(ii) The amount of compost stored at the facility shall not exceed the designed storage capacity. The Tarboro YW facility is in
violation of this rule in that over 6000 cubic yards of waste has apparently been dumped on the site. In order for the Tarboro Baker
St. YW facility to be brought into compliance, locate an end user for the yard waste and begin removal.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The YW facility is located on the same property as the old Tarboro town dump. It is not known where the boundaries of
the old dump are located.
2. 15A NCAC 13B .1404 SITING/DESIGN REQUIREMENTS FOR SOLID WASTE COMPOST FACILITIES (7)
requires that "any portion of a compost facility located over a closed solid waste disposal facility shall be located over a
pad". If any portion of the notified YW facility is found to be located over the closed Tarboro Dump, this yard waste
either must be moved to an area not part of the old closed dump or a pad constructed over the old waste. Sites located
over a closed out disposal area may require a permit according to 15A NCAC 13B .1402 (g)(3)(D). The boundaries of
the Tarboro Town dump need to be located to ensure that YW is not dumped and processed over this area.
3. The property is owned by the Town of Tarboro and is a 14.56 acre tract parcel ID# 473991405200 and is recorded in
Book 885 page 189 of the Edgecombe Co. Register of Deeds.
4. The YW notification is current and was submitted on April 12, 2012.
5. Clean loads of leaves can be passively composted in "static piles" which require minimum management. Temperatures
should be checked to prevent spontaneous combustion and require turning annually. There should be a separate pile for
each year. Composting normally takes from six to twelve months. It is best to collect leaves and other yard waste
separately.
6. Large volumes of grass clippings and waste with a low carbon nitrogen ratio will need to be composted as is listed in
item 4.
7. Time and Temperature: Yard waste facilities shall follow the time and temperature requirements listed in 15A NCAC
13B .1406(10) for all yard trash feed stocks. The temperature requirements include the compost process being
maintained at or above 55 degrees Celsius (131 degrees F) for 3 days and aerated to maintain elevated temperatures.
Yard trash is defined within 130A-290(a)(45) as solid waste consisting solely of vegetative matter resulting from
landscaping maintenance. Leaves from landscaping maintenance and grass clippings are considered yard trash.
8. Brush and woody waste should be piled separately for future grinding.
9. A gate at the entrance to the facility is provided, but is generally kept open. Lewis indicated during a conversation on
January 27th that there are problems with individuals entering the site from other areas.
