Myers, Sr. and Marty Lee Myers on January 6, 2010. This permit will expire on January 6, 2015. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 2 of 2 ADDITIONAL COMMENTS 1. This facility consists of a permitted Land Clearing and Inert Debris Treatment and Processing Facility which is permitted to accept land clearing and inert debris (LCID) material, untreated and unpainted wood, wooding pallets, and high C:Nratio yard trash. 2. Daily tonnage records were being maintained as required. 3. The permit and operations plan were reviewed. A copy of the Permit to Construct/Operate has been included with this inspection report so a copy can be maintained at the facility office. 4. A significant amount of mulch was on site at the time of inspection. Good access was provided around most of the material. However, an adequate fire lane needed to be established between the two mulch windrows located closest to the facility office. 5.. Some slight ponding was observed within the operational area. However, this was the result of recent heavy rains that occurred prior to inspection of the facility. 6. Permit Condition 415 requires that a 100-foot buffer to property lines be maintained free of waste and final product. During the inspection, un-ground material was observed within the 100-foot buffer on the south side of the property adjacent to Shallowford Road. The windrows located closest to the facility office were also found to be located too close the property line on the east side of the property. Please ensure that waste is not placed within the required buffer. Staging and storage areas should be adjusted as needed. 7. No unacceptable waste streams were observed within the operational area or stockpile areas. 8. Some unacceptable material had been placed in a designated area on the east side of the property. Material primarily consisted of silt fence and rubber tubing. Mr. Myers stated that this material would be taken to a properly permitted facility. 9. Topsoil is screened from processed LCID waste on the northern portion of the property. 10. A gate was provided at the entrance to the facility to prevent unauthorized access. 11.
