Copeland, Owner/President STATUS OF PERMIT: Yard Waste Facility Notification application received by the SWS on May 24, 2011 Yard Waste Facility Notification approval letter issued by the SWS, June 2, 2011 Yard Waste Facility Notification expires on June 1 of each year PURPOSE OF SITE VISIT: Comprehensive Audit (to ensure that the Yard Waste Facility Notification is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .1404(a)(1)-(10), 13B .1406, and the requirements as stated on the Yard Waste Facility Notification application and the Yard Waste Facility Notification approval letter. STATUS OF PAST NOTED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 OBSERVED VIOLATIONS None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS On October 14, 2011, John Patrone met with Will R. Copeland to conduct a comprehensive audit of the Apex Nurseries, Inc. YWN Site No. 2 located on Copeland Road in Apex, Chatham County. 1. The yard waste notification (YWN) facility is operated on property owned by Jean Copeland, serving Apex Nurseries, Inc. 2. Apex Nurseries, Inc. has an additional YWN for an adjacent parcel of land, ID No. 19-006 YWN Site No. 1. 3. At the time of the audit there was no material associated with the operation at the facility, unprocessed or processed. 4. Mr. Copeland stated that the facility is not in operation and may be used as "overflow" for YWN Site No. 1, 19-006. 5. Apex Nurseries, Inc. has stockpiled a large quantity of ground material/mulch on the site. Mr. Copeland stated that the material was brought on site and will be used as product for nursery maintenance and sale. 6. Mr. Copeland stated that the ground material/mulch will be used/sold within the coming months. 7. Stockpiled ground material/mulch should not infringe on future YWN operations, to include area dedicated to LCD storage and processing. 8. The facility should ensure that there is an adequate buffer area between future unprocessed LCD and stockpiled mulch (brought on site). The buffer area should be > 50 feet and is suggested to be as wide as possible. 9. Mr. Copeland stated that the facility will not regularly accept material with high nitrogen carbon ratio and expects to only process LCD into mulch. 10. The facility shall maintain throughput records and process or store less than 6,000 yd3 of material per three month period. 11. Mr. Copeland was reminded that if material with high nitrogen carbon ratio is received temperature monitoring is required. 12. Compost piles shall be monitored for 3 days at a temperature > 131 ° F and aerated accordingly. Records of compost pile temperature shall be maintained. 13. Compost windrow dimension should not exceed a height of 12 feet and a width of 20 feet (minimum dimensions of 6 feet in height and 9 feet in width). 14. Ensure that compost windrow thermometer annual calibration records are maintained. 15. The YWN operation shall maintain a 50' buffer from property lines, 200' buffer from buildings (not owned or occupied by the permittee), 100' buffer from wells, and 50' buffer from perennial streams/rivers. 16. A fire lane shall be maintained that can accommodate emergency vehicles. Mr. Copeland stated that the property has several ponds with corresponding pump stations available for fire control. 17. No erosion or runoff was observed. 18. The access road is of all-weather construction. 19. Facility personnel live adjacent to the entrance to the YWN site/Copeland Road and can provide oversight. 20. Ensure signage is posted to include responsible party contact name and phone number, acceptable wastes, dumping procedure, hours of operation, and permit number. Signage shall also state that no hazardous waste, asbestos containing waste, or medical waste accepted. 21. The Yard Waste Facility Notification must be renewed annually, by June ls` FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 22. If in the future Apex Nurseries, Inc. plans to accept waste generated by a disaster, contact the SWS regarding a temporary disaster debris staging site (TDDSS).
