OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility is a land clearing and inert debris (LCID) landfill. 2. Proper facility sign posted at the facility entrance showing the contact name and number in case of an emergency and the permit number. 3. The facility is properly secured with a locked gate. Personnel are on site during operating hours which are Monday through Friday from 7:30AM to 5:30PM and Saturday from 8:OOAM to 1:OOPM. 4. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and asphalt. 5. The facility site plan, operations plan, and permit were not reviewed with the site operator at this inspection. 6. The facility is not currently burying waste within the LCID. Mining and grinding operations are taking place on top of the LCID. 7. The facility needs to be mowed to allow for proper inspection of the side slopes. Woody vegetation also needs to be removed from the side slopes. 8. October 8, 2018 Permit to Operate, Attachment 3, Part V (7), "Excavation, grading and fill material side slopes must not exceed three horizontal to one vertical (3:1)." During this inspection, it was determined that the side slopes were steeper than 3 horizontal to 1 vertical. The side slopes need to be regraded to meet the slope identified in the Permit to Operate. 9. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Sections .0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be of height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers are visible when standing at a marker." Due to the overgrown vegetation on the side slopes, the edge of waste markers could not be located. Ensure that the edge of waste markers have been installed and are visible from one to the next. 10. The facility site plan, operations plan, and permit and were not reviewed with the site operator at this inspection. 11. 15A NCAC 13B .0566 (8), "Surface water shall be diverted from the working face and shall not be impounded over waste." An area of standing water was identified between a ground mulch pile and unprocessed waste. The area should be filled in a graded to promote drainage away from the top of the LCID. 12. A ditch had been dug between the base of the LCID and ground mulch piles to drain organic leachate into a basin. Ensure that no leachate is leaving the facility. 13. Corrective measures are necessary as a result of this inspection and should be completed within 30 days' receipt of this report. 14. Digital pictures were taken during the inspection.
