Notice of Brownfields Agreement and Land Use Restrictions
1. Addendum. This is an addendum to the
Apartment Lease Contract (referred to as “Lease
Contract” or “Lease” for Apt. No. ___ in the
Trade & Graham Associates, LLC community in
Charlotte, North Carolina.
2. Brownfields Agreement. The property which is
the subject of the Lease Contract is subject to the
Brownfields Agreement attached as Exhibit A to
the Notice of Brownfields Property recorded in
the Mecklenburg County land records, Book
29451, Page 216. The land on which the
apartments have been built was historically used
for a gas station and auto maintenance facility,
and investigation identified contamination in soil
and groundwater at the property prior to
development. As part of the Brownfields
Agreement, the North Carolina Department of
Environmental Quality (“DEQ”) imposed certain
land use restrictions on the site to ensure its use
remains safe for human health and the
environment.
3. Land Use Restrictions. The land use restrictions
allow the use of the property for mixed-use,
multi-family residential, retail, office, open
space, and parking activities. The owner of the
apartment site and the apartment units has been
required to include certain building systems,
make certain annual reports, refrain from
disturbing soil on the property, and refrain from
using underground water for drinking, irrigation
or other purposes.
4. Declaration. You may obtain a copy of the
Notice of Brownfields Property from that office
or, without charge, from the on-site manager.
Both you and we must comply with the
provisions of the Notice.
