I wanted to follow up on the communication below. Promptly after receiving your authorization to correct the oversight
as to PD’s lease disclosure obligations under land use restriction 12 for the referenced Brownfields Agreement, the PD
sent along to its tenants the one‐time notice you suggested. A copy of that notice is enclosed. Also, a screen shot
showing distribution of the notice to all tenants on April 14, the same day as your authorization, is set out below:
PD, as promised, is utilizing updated Brownfields lease disclosures in all lease renewals going forward.

Thank you for providing the revised lease addendum for our review as required by land use restriction No. 12 of the
recorded Notice of Brownfields Property. In my review of the revised addendum, I found it to be consistent with the
provisions put forth in the land use restrictions. Additionally, the 30 day moratorium is hereby waived for the
implementation of this approved revised addendum.
To provide timely notification to tenants, paragraph 22 of the recorded Agreement requires Prospective Developer
provide a copy of the Agreement to any current lessee or sublessee on the Property within 7 days of its effective date or
of subsequent leases. Due to the material change of the lease addendum containing a corrected reference to the
recorded Notice/Agreement, please provide an one‐time notice (either by email/letter/website) of the effective change
to all tenants subject to the new addendum within 30 days (by May 14th) of this approval for use. A brief email outlining
those completed notification actions to tenants can be sent to Tracy or me upon completion. The revised addendums
can then be implemented per the provided schedule outlined in your email confirmation request.

Tracy,
I’m reaching out on behalf of Trade & Graham Associates, LLC, the PD at the referenced Brownfields Property, to get
confirmation from the Brownfields Property Management Unit on the approach the PD would like to take on an issue it
recently became aware of.
For background, the Brownfields Agreement for this property was recorded in 2014, and the PD built an apartment
community at the site. It’s an urban property (in Uptown Charlotte) with little unpaved property and only modest
historic vapor concerns (only a vapor barrier was required at the property).
Since occupancy of the property began, the PD has advised its tenants in writing that the property was contaminated,
that the property was subject to land use restrictions, and that the property was subject to a recorded document with
DEQ. The PD also ensured that a copy of the Brownfields Agreement for the property was available upon
request. However, PD recently noticed that its lease disclosure includes an inaccurate reference to the recorded DEQ
document.
Since discovering this inaccuracy, PD revised the addendum to include the correct information. A copy of that document
is enclosed. The document will be provided to and signed by current tenants on a rolling basis as their leases are
renewed. It will also be provided to new tenants. Since leases are generally renewed annually, PD anticipates having
the revised notices in place with all tenants in under a year.
Can you please confirm that the PD’s proposed approach to correcting its lease notices is acceptable? Also, can you
please confirm that the enclosed lease notice suffices as an acceptable notice under the Brownfields Agreement?

Dear Residents,
Thank you for calling The Mint your home. We wish to take this time to inform you
of a recent update that has been made to our lease contracts.
As part of your lease agreement, you signed an addendum related to land use
restrictions affecting The Mint. We have updated the addendum so that it now
references the Notice of Brownfields Property recorded with the Register of
Deeds at Book 29451, page 216.
No action is needed at this time and this does not impact your current lease
agreement but will be updated during your next renewal contract as the Notice
of Brownfields Agreement and Land Use Restrictions.
