The North Carolina Department of Environmental Quality (DEQ) Brownfields Program received and reviewed the Vapor Intrusion Mitigation System Progress Report-South Tower dated November 6, 2020 and VIMS Post-Occupancy Indoor Air Sampling Report-South Tower date May 14, 2021 (Reports) prepared by Hart & Hickman, PC and submitted on behalf of the property owner Cousins Railyard, LP. DEQ Brownfields understands the south tower has been developed
in accordance with the Vapor Mitigation Plan dated June 20, 2018 and modifications to the approved VIMP submitted to DEQ via email and approved on March 18, 2021. DEQ Brownfields reviewed the analytical data and monitoring data provided in the Reports, and evaluated the analytical data using the DEQ Risk Calculator. The results of this evaluation were
below the DEQ thresholds for non-residential use. Based on the available data, DEQ Brownfields
has determined that the above referenced south tower is currently in compliance with Land Use Restriction 8.c. of the Notice of Brownfields Property. DEQ Brownfields understands, ongoing monitoring and assessment shall be conducted in
accordance with the VMP and the subsequent Compliance Review Letter dated March 18, 2021.
Please note, this occupancy approval is contingent upon completing the first floor construction and subsequent submittal final installation summary report as required by the approved Vapor Mitigation Plan dated June 20, 2018.
