During a review of the land application site logs submitted for the permit renewal it appeared that the monthly application rates (as per the approved nutrient management plan) were exceeded on the following months. - July 2019 on Field C, site logs indicated that 58,550 gallons were discharged, but only 49,500 gallons were allowed (High monthly rate of 15,000 gallons x 3.3 acres for Field C). - September 2019 on Field B, site logs indicated that 44,700 gallons were discharged, but only 40,000 gallons were allowed (Medium monthly rate of 10,000 gallons x 4.0 acres for Field B). - October 2019 on Field C, site logs indicated that 23,900 gallons were discharged, but only 16,500 gallons were allowed (Low monthly rate of 5,000 gallons x 3.3 acres for Field C). - January 2020 on Field C, site logs indicated that 26,500 gallons were discharged, but only 16,500 gallons were allowed (Low monthly rate) - February 2020 on Field C, site logs indicated that 18,000 gallons were discharged, but only 16,500 gallons were allowed (Low monthly rate). - May 2020 on Field B, site logs indicated that 53,800 gallons were discharged, but only 40,000 gallons were allowed (Medium monthly rate). FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 Site logs need to be monitored thru each month to determine how many gallons have been applied to any of the permitted disposal fields & to ensure that the monthly application rates (as per the approved nutrient management plan & the permitted field acreage as per the SLAS permit) are not exceeded. Once a monthly application rate has been reached on a disposal field land application shall cease on that specific field and an alternate disposal location (another permitted field, SDTF or WWTP) shall be used. Also please ensure that the site logs indicate how many gallons were discharged on each field separately during the winter months when all of the site may be utilized. It was noted that during this review of the submitted site logs that the maximum annual application rates for each field (50,000 gallons X each field acreage) or for the entire site (50,000 gallons X 14.7 acres) were not exceeded. Please contact this office if additional guidance/information is needed in regards to the monthly or annual application rates specific to this site. ADDITIONAL COMMENTS 1. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
