PURPOSE OF SITE VISIT: Comprehensive Follow Up Inspection STATUS OF PAST NOTED VIOLATIONS: IS262002 15A NCAC 13B .0103 (e) – UNRESOLVED 15A NCAC 13B .0106 (a) – UNRESOLVED NC General Statute 130A-294 (m) – UNRESOLVED Closed N0467 15A NCAC 13B .0201 (a) and (c) – UNRESOLVED FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 OBSERVED VIOLATIONS: N/A ADDITIONAL COMMENTS 1. Section staff inspected this site, originally, due to waste being seen from access road to illegal site at rear of property IS262002, also Donald Raynor, for dumping same concrete waste into Little River. Solid Waste Section records indicate this landfill facility was closed in 2008. Further, landfills authorized under 15A NCAC 13B .0563 are not transferrable with the sale of the property. Cumberland County records indicate that the property containing the landfill was sold in 2000, thus making the original notification filed by Bobby Godwin, former property owner, invalid. There are no records with the Register of Deeds that a new permit or authorization was ever issued. As such, this facility cannot be operated for the purposes of fill or disposal with approval of the Division of Waste Management. IS262002 2. Staff visited site today to follow up on corrective actions outlined in previous inspections reports, Notices of Violations and onsite meeting compliance goals. Waste was still present and uncovered. Must remove and dispose waste at landfill for that waste type. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Waste has not been removed from the closed NCLIDLF (Notified Land Clearing and Inert Debris Landfill). No communication has been received from owners on either closed NLCIDLF or IS262002. 4. All waste visible on the surface of the ground and partially buried must be removed from the property for proper disposal at a facility permitted by the Division to receive said waste type(s). Provide all documentation of proper waste disposal. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 4 5. IS262002 – A Notice of Violation was sent on November 12, 2020, and received on November 14, 2020. A time frame of 45 days within receipt of that notice was given for coming into compliance. An extension was requested by Mr. Raynor during the December 15, 2020 inspection. The end of January 2021 was agreed to onsite. A Notice of Additional Violations was sent on January 8, 2021, and received January 11, 2021. Additional time was granted to allow for 30 days since receipt of this notice before following up at both sites. Hardly any waste has been (re)moved and no communication from Mr. Raynor on progress. A Notice of Continuing Violations was sent March 2, 2021, and received March 8, 2021. Mr. Powell visited site on May 5, 2021 and confirmed hardly any waste had been moved or removed. Most, if not all, was still in same place. Will move forward with Compliance Order. 6. Corrective measures are necessary as result of this inspection. Cease accepting waste at both sites. A follow up compliance inspection will be conducted by Solid Waste Section Staff. Failure to meet the conditions for compliance may result in further Compliance Actions. Mr. Raynor should communicate with David Powell with the Section on progress at both sites.
