The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Section staff Mr. Powell met onsite with Mr. Pandure to follow up on corrective measures.
2. Mr. Pandure walked site with Mr. Powell and showed him the new edge of waste (EOW) markers installed. PVC
pipe was used on all corners. T-posts from silt fence still visible. Repair silt fence were needed for erosion control Good job.

3. Waste had been pushed over edge, like a cliff, on the east side of notification. This waste was pulled back, sloped and covered as requested mostly. However, the slope on back left corner and back side was still steeper than 3 to 1 ratio. For every 1 foot of height there should be 3 feet of width of slope on the structure. This is after covering of soil to proper depth and inside EOW. Mr. Powell inadvertently told Mr. Pandure incorrect information while onsite about the requirements for 3 to 1 slope for covering the NLCIDLF. After reviewing the new rules again, Mr. Powell remembered this was now a requirement in the new readopted .0566 rules for operational requirements for LCIDLF’s. Mr. Pandure should fix this sloping issue immediately to comply with new rules. Onsite discussions did include Mr. Pandure fixing this soon and forwarding a couple pictures of this corrective action completed.
15A NCAC 13B .0566 - (2) Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time.

4. Plenty of soil was staged for covering. Previous waste was all covered and compacted. Some new waste was
present and needed covering soon.

5. Inspector sent Mr. Pandure new NLICD rules (.0563 - .0567) via email on 3/5/2021. Please read and review to ensure this facility becomes compliant with these rules moving forward. Onsite discussions also included the
probably of selling this NLCIDLF and what that would mean for next owner. These notifications cannot be transferred and normally could be redone in new owner’s name. However, with new rules eliminating NLCID’s in 5 years, must become permitted or close down, the only way to continue operating would be to get this site permitted. That’s of course if it meets certain buffers, requirements etc. Ming Chao is the permitting engineer with the Section for Hoke County. His contact info is (919) 707-8251 or ming.chao@ncdenr.gov. Property owner of the NLCIDLF after the 5-year period, if not permitted, will need to follow Closure and Post Closure Care rules .0567.
6. Areas that had recently been covered had new vegetation being established and notification had all weather access around perimeter. Good job.
7. Corrective measures are necessary as result of this inspection. Please submit couple pictures showing back slope fixed 3:1 or staff can revisit. David Powell email is david.powell@ncdenr.gov.
