Recorded in Nash County Register of Deeds, Book 2103 — Page 874 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please read through the rules and contact me if you have any questions. Based on rule 15A NCAC 13B .0563 (6), within 5 years of the effective date, notified LCID landfills will need to be properly closed or obtain a permit from the Division of Waste Management. 1. The access road is of all-weather construction and appears to be properly maintained. 2. The gate was locked at the time of this inspection. 3. The site has adequate signage posted at the entrance. The overgrown vegetation in front of the sign should be removed so that the entire sign is visible. 4. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Sections .0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be of height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers are visible when standing at a marker." Edge of waste markers were not visible at the time of this inspection. Permanent, clearly visible edge of waste markers must be established at the site, showing the under two (2) acres boundary for waste disposal. 5. 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ration of three horizontal to one vertical at any time." The side slopes were identified to be uncovered and nearly vertical. The waste needs to be compacted, covered. and properly sloped. 6. Ensure that the waste is covered by six inches of soil monthly or when the working face reaches one acre, whichever occurs first. 7. 15A NCAC 13B .0566 (8) "Surface water shall be diverted from the working face and shall not be impounded over waste." An area of standing water was observed near the working face. The area should be regraded to promote water drainage away from the waste. T 8. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." An access road around the waste disposal area was not evident. The overgrown woody vegetation should be removed so that the area can be accessed via fire -fighting vehicles and equipment. 9. Digital pictures were taken during the inspection. 10. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
