The Notification is recorded in Deed Book 2295, Page 738-740. PURPOSE OF SITE VISIT: Follow-up Compliance Inspection STATUS OF PAST NOTED VIOLATIONS 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first." UNRESOLVED: The waste in the eastern portion of the LCID has not been covered with the minimum of six inches of soil. At the time of this inspection, waste was now being placed along the upper edge and in the western portion of the mined area. The waste in the western portion of the mined area will need to be compacted and covered with six inches of soil monthly or when the working face reaches one acre in size. 15A NCAC 13B .0566 (1), "The facility shall only accept those solid wastes which it is permitted to receive." UNRESOLVED: At the time of this inspection, non -conforming wastes, such as asphalt shingles and painted block, were observed within the eastern portion of the LCID. Painted block may only be accepted, if analytical data determines that there is no lead within the paint. Any non -conforming waste MUST be removed and properly disposed of. Page 1 of 5 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA o"' t0E'"�m"""°"""' Solid Waste Section 15A NCAC 13B .0564 (6) (b), "The facility shall meet the following buffer requirements ... 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells." RESOLVED: A review of Halifax County Tax Assessor documents, identified that Mr. Myrick had recombined the two parcels 0706077 and 0700046 in order to meet the proper buffer requirements. OBSERVED VIOLATIONS 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ration of three horizontal to one vertical at any time." As identified in the comments of the September 24, 2020 and January 19, 2021 inspection reports, the slopes of the of the mined area in the western portion of the were identified to have vertical slopes. Waste was identified placed along the upper edge of and within the mined area has not been compacted or properly sloped to a 3:1 ratio. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: A copy of the new LCID rules, which became effective on January 1, 2021, are provided with this report. Please read through the rules and contact me if you have any questions. Based on rule 15A NCAC 13B .0563 (6), within 5 years of the effective date, notified LCID landfills will need to be properly closed or obtain a permit from the Division of Waste Management. 1. The facility is properly secured with a locked gate. 2. The access road is of all-weather construction and appears to be properly maintained. 3. Concrete debris was identified to be stored within the waste footprint, to the west of the entrance road. The amount of the concrete debris stored within the waste footprint has not changed size between the September 21, 2020 and April 21, 2021 inspections. The concrete must be properly covered with soil if it is meant to be disposed of. If it is to be recycled, it should be removed from the landfill and 75% must be processed, used and removed from the property within the calendar year it was placed on the site, as stated in § 130A 309.05 (c)(1), "Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of the calendar year commencing January 1, shall be removed from the facility through sale, use or reuse by December 31 of the same year." 4. 15A NCAC 13B .0201 (g), "disposal area boundaries for landfills permitted in accordance with Sections .0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be of height and spacing so that they are distinguishable from the surrounding landscape, and so that they adjacent markers are visible when standing at a marker." The eastern most edge of waste marker was found during this inspection. The eastern most marker was not visible from the closest adjacent edge of waste markers. Additional markers may need to be installed or the vegetation cleared so that the edge of waste boundary can be properly delineated. The waste deposited along the upper edge of the mined area, appeared to be outside of the edge of waste markers. Ensure that the waste is within the edge of waste boundary. 5. 15A NCAC 13B .0566 (5), "erosion control measures, structures, or devices shall be utilized to prevent silt from leaving the site and to prevent on -site erosion and shall comply with 15A NCAC 04." Large erosion rills were identified in the mining area and along the eastern portion of the partially covered waste. The erosion rills need to be repaired, properly graded, and stabilized with vegetative ground cover. 6. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." Ensure that an access road is established around the waste boundary. 7. A sign shall be posted at the site entrance showing the site contact's name and phone number, the permit number (the site notification number should be used here), emergency contact information and the waste types accepted for disposal at the site. 8. Remove any trees and deep root penetrating woody vegetation that may be growing over the waste. 9. Corrective measures necessary to bring this site into compliance should be completed by June 24, 2021. 10. Digital photographs were taken during the inspection.
