Current status of Land Clearing and Inert Debris Landfill is OPEN. PURPOSE OF AUDIT: Update Comprehensive Audit (to ensure that the Land Clearing and Inert Debris (LC1D) Landfill is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566). NOTICE OF VIOLATION(S): None You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. STATUS OF PAST NOTED VIOLATIONS: None FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section : Page 2 of 2 AREAS OF CONCERN AND COMMENTS: On June 8, 2009, John Patrone conducted a follow-up compliance audit of the Land Clearing and Inert Debris Landfill located at 5500 Leonard Farm Road in Kernersville, Forsyth County. 1. The LCID landfill is located on a tract of land, owned by Mr. Sells, which also had a Land Clearing Debris Treatment and Processing (T&PN) facility (No. T&PN-34-012) located on it. The T&PN facility is currently not in operation. 2. Due to the excessive amount of LCID material stored on site (— 18,000 yd3) associated with the T&PN facility, Mr. Sells had opted to bury the material in the LCID landfill; which met the requirements of an approved solid waste disposal facility. 3. Mr. Sells has covered all of the LCID material on -site with soil and the slopes appear to be graded appropriately. The soil cover should be at least 1 foot in depth and the slopes should not exceed a 3:1 slope ratio or a ratio of which no indication of erosion or runoff occurs. The edge of waste appeared to meet required setbacks. Mr. Sells has stated, previously, that the LCID landfill meets the required setbacks. 4. The LCID landfill has been seeded with grass, which is in the process of establishing itself atop the cap and along the slopes. 5. Areas of erosion along the slopes of the landfill must be repaired. 6. The sedimentation and erosion catch -basin must be cleaned -out. 7. The channel leading to the sedimentation and erosion catch -basin must be repaired. 8. The channel along the toe of the slope (adjacent to Leonard Farm Road) should be filled with soil and seeded. 9. If, after the aforementioned is adequately addressed, you would like to have this site closed -out such that the Land Clearing and Inert Debris Landfill Notification is no longer active you must contact this office. 10.
