Science & Health Specialist Kerry Venable, Venable & Son General Contractor STATUS OF PERMIT: Land Clearing and Inert Debris Landfill Notification application filed for recordation in the Forsyth County Register of Deeds' Office on March 17, 2005. Current status of Land Clearing and Inert Debris Landfill Notification is OPEN PURPOSE OF AUDIT: Compliance Audit (to ensure that the Land Clearing and Inert Debris (LCID) Landfill is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566). NOTICE OF VIOLATION(S): None. You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 2 of 2 STATUS OF PAST NOTED VIOLATIONS: None. AREAS OF CONCERN AND COMMENTS: On April 21, 2009, John Patrone met with Tom Westmoreland, Minor Barnette, Jim Bryan, and Kerry Venable and conducted a compliance audit of the Land Clearing and Inert Debris Landfill located on Walnut Cove Road (Hwy 311 South) in Walkertown, Forsyth County. 1. Mr. Westmoreland was reminded to limit the size of the working face to the smallest area feasible and to ensure that the LCID material is adequately covered with soil on a monthly basis. 2. Logs stored on -site should be removed every three or four months. 3. The property owned by Mr. Westmoreland includes a Duke Power Company transmission line right-of-way. Mr. Westmoreland stated that the LCID landfill (maximum 2 acre footprint) is > 100 feet from the right-of-way. 4. The facility is secured by means of a gate and berm. 5. The access road is of all-weather construction, made of crushed asphalt. 6. The facility had proper signage. 7. Mr. Westmoreland was reminded that open burning of solid waste is prohibited. And to ensure that treated wood is not burned for comfort heat. 8. Mr. Westmoreland is considering operating a Land Clearing Debris Treatment and Processing Notification (T&PN) operation adjacent to the LCID landfill and was given a T&PN application. 9. Mr. Westmoreland was told that if the T&PN application is approved, by the SWS, he must install permanent boundary markers, create a 15 — 25 foot fire lane between the LCID landfill and T&PN operation, and meet all required setbacks and any other requirements as stated (by the SWS). 10. Mr. Patrone stated that the T&PN operation (maximum 2 acre footprint) should meet required setbacks from the Duke Power Company transmission line right-of-way. 11. As per the T&PN operation, Mr. Westmoreland was told that records must be kept indicating the amount of material received, the type and amount of material created, the type and amount of material reused, recycled, or distributed (not to exceed 6,000 yd3 per three month period/quarter) And that all requirements of the T&PN application must be adhered -to.
