Permit to Operate will expire April 17, 2025. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTICE OF VIOLATIONS: None. OBSERVED VIOLATIONS: Date of Last Inspection: N/A 3505-LCID-2020 A. 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time." During this inspection, whole logs were identified at the top of the LCID. The whole logs could not be compacted properly, which resulted in a large void beneath the logs. Whole logs should be cut into smaller pieces to allow for proper compaction. A roadway to the top of the landfill had been cut into the LCID waste. The waste needs to be properly covered and sloped. B. 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first." During this inspection, it was determined that the uncovered waste at the top of the LCID was greater than one acre in size. The LCID waste needs to be properly covered with a minimum of six inches of soil. 3505-TP C. 15A NCAC 13B .0301 (d)(2), "Operations Plan ... the procedures for receiving, screening, processing, handling, salvaging, storage, treating, and removal of waste and recovered materials, including the anticipated processing, treatment and storage times." During this inspection, it was determined that the facility was utilizing a carbonizer as a treatment process for wood products. A stockpile of wood products which included engineered wood, plywood, and wood with backing was identified directly adjacent, to the south, of the carbonizer. A pile of biochar comingled with metal debris was identified directly adjacent, to the north, of the carbonizer. The carbonizer is not identified as an approved treatment or process in the Permit to Operate. A permit modification for the use of a carbonizer must be submitted to Diana Felix at diana.felixkncdenr.gov. The wood waste to be used in the carbonizer should consist of clean, untreated, and unpainted wood waste. The current stockpile of char should be disposed of properly. D. April 17, 2020 Permit to Operate Part VI (35), "Storage of pre-processed debris must be limited to a maximum of 30 feet high and 50 feet wide. A minimum of 15—foot row aisles must be maintained to separate the piles." and April 25, 2020 Permit to Operate Part VI (36), "Storage of finished product/mulch must be limited to a maximum of 30 feet high and 50 feet wide. A minimum of 15-foot row aisles must be maintained to separate piles in all storage areas." During this inspection, it was determined that the pre-processed and processed wood piles were determined to be greater than 50 feet wide with no windrows between the pre-processed and processed wood piles. The process wood waste was identified to be directly adjacent to the pre-processed wood waste. The pre-processed and processed piles need to be separated by a minimum 15-foot row aisle and properly sized for management of the waste. 3505-MWP E. April 17, 2020 Permit to Operate Part VI (44)(C), "Waste may be stored on -site, in leak proof containers, with watertight covers, in accordance with the approved documents. Storage of the waste must not cause any nuisance, such as odor or attraction of vectors." During this inspection, a large pile of shingles was identified to be stored on the ground, adjacent to and east of the mixed waste processing (MWP) area. A pile of mixed wood waste, located adjacent to the carbonizer, was also stored directly on the ground. The shingles and mixed wood waste piles CANNOT be stored directly on the soil and MUST be placed within leak proof containers with a watertight cover. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." and 15A NCAC 13B .0301 (6)(1)), "Buffer Requirements ... surrounded by an unused and cleared area of no less than 25 feet to allow access for fire or Page 2 of 5 FACILITY COMPLIANCE INSPECTION REPORT D E Q Division of Waste Management NORTH CAROLINA Solid Waste Section emergency response vehicles." An access road was not identified around the wood waste T&P area or along the eastern slope of the LCID. An access road should be established and maintained around all areas for fire and emergency response vehicles. 2. April 17, 2020 Permit to Operate Part VI (51). "The facility shall store no more than 500 total tons of materials on -site, in accordance with the approved documents. Failure of the facility to comply with this condition will require the facility to immediately cease and desist all operations until the appropriate amount of stored material is reached." Ensure that no more than 500 total tons of materials are on site in the MWP area at one time. The facility appears to be approaching the 500 total tons of material, including the shingles and mixed wood waste. No treated wood should be processed at this site per the permit. 3. April 17, 2020 Permit to Operate Part VI (37), "The facility must be operated and maintained with sufficient dust control measures to minimize airborne emissions sand to prevent dust from becoming a nuisance or safety hazard. Fugitive dust emissions from the facility contribute to substantive complaints may subject the facility to the Division of Air Quality requirements as listed in 15A NCAC 2D .0540." During the inspection, dust plumes were visible behind the vehicles accessing the facility. As per the Operations Plan, a water truck should be available on -site to wet the roadway and prevent the dust plumes. Mr. Wall stated that he has a water truck available, however, one is not permanently located at the facility. Other than dust, the access road around the facility was stable and no soil erosion was noted. 4. 15A NCAC 13B .0564 (6)(b), "Buffer Requirements: A site shall maintain the following buffer requirements: 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells." and April 17, 2020 Permit to Operate Part VI (32), "A buffer of at least 100 feet must be maintained between the property line and the treatment and processing operation." During this inspection, it appeared that the western and southern waste boundaries were encroaching on the western and southern adjacent properties. The southern edge of the concrete recycling area appears to be encroaching on the southern adjacent property as well. The wastes need to be moved away from the property line so that the 100-foot buffer has been met. Ensure that necessary buffers are met and markers in place. 5. Granite countertops were identified within the concrete processing area. The countertop material to be recycled cannot be treated with sealants or have any glues or backing. Other unapproved waste should be removed as well. 6. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. 7. Records were reviewed during this inspection. 8. Standing water was observed around the base of the shingle storage piles. The area needs be regraded to promote positive drainage, away from the shingle storage piles. 9. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. 10. Digital pictures were taken during the inspection.
