STATUS OF PERMIT:
Land Clearing and Inert Debris Landfill Notification application received by the SWS on April 12, 2002.
Land Clearing and Inert Debris Landfill Notification approval letter dated June 5, 2002 was issued from the SWS to
North State Enterprises and copied to Kenco Grading, Inc./Ken Prater.
Current status of Land Clearing and Inert Debris Landfill Notification is OPEN
PURPOSE OF AUDIT:
Compliance Audit (to ensure that the Land Clearing and Inert Debris (LCID) Landfill is in compliance with 15A North
Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566).
NOTICE OF VIOLATION(S):
None.
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for
each violation of the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions
including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such
further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

STATUS OF PAST NOTED VIOLATIONS:
None.
AREAS OF CONCERN AND COMMENTS:
On April 30, 2009, John Patrone conducted a compliance audit of the Land Clearing and Inert Debris Landfill located at
984 Hoyd Lane in Kemersville, Forsyth County.
1. The LCID landfill is no longer in operation.
2. Kenco Grading, Inc. no longer operates its business at the facility address. Mr. Prater stated that the LCM landfill
has been closed/not in operation for — 3 years.
3. The property owner is North State Enterprises, Inc./Henry Thomas. The property owner is responsible for ensuring
the LCID landfill is properly maintained.
4. The LCID landfill is located adjacent to the gravel drive leading to (the building at) 984 Hoyd Lane, within a chain
link fenced area.
5. The fill area is covered with soil and contains natural vegetation. It slopes modestly such that surface water is not
impounded and runoff is controlled.
6. The landfill appeared to meet required setbacks. Buffers must be maintained as per 15A NCAC 13B .0564(9), "...(a)
50 feet from the waste boundary to all surface waters of the state..., (b) 100 feet from the disposal area to property
lines, residential dwellings, commercial or public buildings, and wells..."
7. If the property is subdivided the LCID landfill must be contained on a contiguous lot that includes all required
setbacks.
8. A copy of the Land Clearing and Inert Debris Landfill Notification will be mailed to Mr. Thomas.
9. A copy of the rules pertaining to Notified LCID landfills will be mailed to Mr. Thomas.
10. If you would like to have this site closed -out such that the Land Clearing and Inert Debris Landfill Notification
is no longer active you must contact this office.
