PURPOSE OF AUDIT: Comprehensive Audit NOTICE OF VIOLATION(S): None You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. STATUS OF PAST NOTED VIOLATIONS: None FACILITY COMPLIANCE AUD1T REPORT Division of Waste Management' Solid Waste Section Page 2 of 3 AREAS OF CONCERN AND COMMENTS: On December 10, 2009, John Patrone met with David Smith and conducted a comprehensive audit of the Small, Type III Solid Waste Compost facility located at 421 West 27a' Street in Winston-Salem, Forsyth County. 1. The facility site plan and operations plan were verified. 2. The facility is a Small, Type III Solid Waste Compost Facility. It produces compost from manure, straw, mulch, and scrap food -wastes generated primarily at the Dixie Classic Fair (held annually in the fall) at the Lawrence Joel Veterans Memorial (LJVM) Coliseum and from various other events (involving animals) held on -site throughout the year. 3. The compost produced is used by the Winston-Salem Sports & Entertainment Complex (site where the LJVM Coliseum is located) as landscape mulch and for animal bedding. The facility is permitted to distribute compost to the general public, however Mr. Smith stated that compost is not distributed. 4. The facility uses the static aerated compost method. After an event material is brought on -site and placed in six large bins, or as many as is needed. Each bin is separated from the other by large cement blocks. Over a period ofweeks the material is tumed/mixed by moving it from one bin to the other. Material is turned/mixed in bins 1 through 6 until it breaks -down and temperature requirements have been met. A seventh bin, larger in size, is used for curing the material from bins 1 through 6. 5. Currently, bins 1 through 6 have material from the Dixie Classic Fair and bin No. 7 is empty. This material will be moved into bin No. 7 in the coming days and material from a recent goat show will be moved into bins 1 through 6. Mr. Smith stated that the material from the goat show will likely be used next fall for the Dixie Classic Fair and the material to be cured will be used for events next spring. 6. Mr. Smith stated that mulch is obtained in — 6 months and compost obtained in — 1 year. 7. Runoff from the facility is controlled by a berm built along the edge of the site. 8. Temperature records were verified. The temperature records demonstrated that the facility obtained> 131 ° F for 3 days and > 104' F for an additional 11 days, with an average temperature of> 113' F. The facility conducts temperature readings daily, for bins 1 through 6. Records were verified from October 20, 2009 through November 30, 2009. 9. Testing records were verified for fecal coliform analysis conducted by Microbac Laboratories, Inc. on March 30, 2009 and Heavy Metals conducted by NCDA&CS — Agronomic Division on April 6, 2009. The facility conducts its own manmade & inert materials test, conducted on April 6, 2009: < 1 % per 35.1 tons. 10. The facility will conduct tests on a February and August rotation. However, the number of animal focused events held at the LJVM Coliseum has decreased in the last year and thus the material available for compost has decreased. Mr. Smith stated that he will conduct the required tests in February but isn't sure if the facility will have additional material by August. The facility had to purchase bedding material (compost) for the Dixie Classic Fair held last October (2009) and may have to purchase more for the Fair in 2010. The facility will test once or twice a year as per the availability of compost (to test) or when throughput is > 20,000 tons. The facility must conduct tests every six months if new material to compost is brought on -site after initial annual testing. 11. The amount of material received from July 2008 through June 2009 is 280.70 tons. The facility currently has 267.3 tons on -site. Mr. Smith maintains records of the quantity and type of waste received, which is all processed and used on -site. A front end loader bucket (as is used on -site) of wet material weighs — 1350 lbs and a bucket of dry material weighs — 1000 lbs. 12. The facility has proper signage (permit number, type of waste permitted to receive, and statement of no hazardous waste, asbestos containing waste, or medical waste).
