You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day maybe assessed for each violation of
the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction
from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve
compliance with the North Carolina Solid Waste Management Act and Rules.

AREAS OF CONCERN AND COMMENTS:
On June 24, 2009, John Patrone met with David Smith and conducted a comprehensive audit of the Small, Type III Solid
Waste Compost facility located at 421 West 27`" Street in Winston-Salem, Forsyth County.
1. The facility site plan was reviewed and its operations plan verified.
2. The facility is a Small, Type III Solid Waste Compost Facility. It produces compost from manure, straw, mulch, and
scrap food -wastes generated primarily at the Dixie Classic Fair, (held annually in the fall) and from various other events
held at the Lawrence Joel Veterans Memorial (LJVM) Coliseum.
3. The compost produced is used by the Winston-Salem Sports & Entertainment Complex (site where the Dixie Classic
Fair is held and where the LJVM Coliseum is located) as landscape mulch and for animal bedding during events. The
facility is permitted to distribute compost to the general public, however Mr. Smith stated that compost is not
distributed.
4. The facility uses the static aerated compost method. After the fair, material is brought on -site and placed in six large
bins, separated by cement blocks. Over a period of weeks the material is turned/mixed by moving it from one bin to
another. A seventh bin, larger in size, is used for curing. Material is tumed/mixed in bins I through 6 until it breaks -
down such that it all is placed in bin No. 7. Mr. Smith stated that the majority of compost used by the facility is used as
animal bedding during the Dixie Classic Fair.
5. In preparation for the Dixie Classic Fair, bin No. 7 is stockpiled, with the material collected (in bins 1 through 6) from
the previous year's Fair. All of the cured material from bin No. 7 is used during the Fair. Material collected from other
events, conducted after the Fair, is placed in empty bins (I through 6), turned accordingly, and put in bin No. 7 to cure.
This material is used -up prior to material from the Fair being placed in the curing bin (No. 7).
6. Mr. Smith stated that mulch is obtained in — 6 months time and compost is obtained in — 1 year.
7. Runoff from the facility is controlled by a berm built along the edge of the site.
8. Temperature records were verified. The temperature records demonstrated that the facility obtained> 131 ° F for 3 days
and > 104' F for an additional 1 I days, with an average temperature of>_ 1130 F. The facility conducts temperature
readings daily, for bins I through 6.
9. Testing records were verified for fecal colifonn analysis conducted by Microbac Laboratories, Inc. on March 30, 2009
and Heavy Metals conducted by NCDA&CS — Agronomic Division on April 6, 2009. The facility conducts its own
manmade & inert materials test, conducted on April 6, 2009: < 1 % per 35.1 tons. Mr. Smith stated that he would like
to have the material tested on a February and August rotation.
10. Tonnage records for 2009 were verified (January through June). The facility received 140,200 lbs or 70.1 tons of
material from events other than the Fair. The tonnage received during the previous year's Fair was — 240 or — 480,000
lbs. A front end loader bucket (as used on -site) of wet material weighs —1350 lbs and a bucket of dry material weighs
— 1000 lbs. Mr. Smith maintains records of the quantity and type of waste received, which is all processed and used.
11. Mr. Smith was reminded that by August 1" of each year the facility is required to submit an annual report for the period
of July 1 s' through June 30t° (to include testing records).
12. The facility has proper signage (permit number, type of waste permitted to receive, and statement of no hazardous
waste, asbestos containing waste, or medical waste).
