STATUS OF PERMIT: Land Clearing Debris Treatment and Processing Facility Annual Notification Form expired June 1, 2008. PURPOSE OF AUDIT: Comprehensive Audit (to ensure that the Land Clearing Debris Treatment and Processing Facility (T&PN) is in compliance with 15A North Carolina Administrative Code (NCAC) 13B, Section .0300 and with the guidelines of the Land Clearing Debris Treatment and Processing Notifications included as part of the Land Clearing Debris Treatment and Processing Facility Annual Notification Form. NOTICE OF VIOLATION(S): See "STATUS OF PAST NOTED VIOLATIONS" You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day maybe assessed for each violation of the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 2 of 3 STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .201(a), "No person shall treat, process, store, or dispose of solid waste or arrange for the treatment, processing, storage or disposal of solid waste except at a solid waste management facility permitted by the Division for such activity..." and 13B .201(c), "No solid waste management facility shall be established, operated, maintained, constructed, expanded or modified without an appropriate and currently valid permit issued by the Division. It is the responsibility of every owner and operator of a proposed solid waste management facility to apply for a permit for the facility...." Corrective action: Innovative Recycling Services Inc shall apply for a Land Clearing Debris Treatment and Processing Facility Notification by February 27 2009 The facility shall cease accepting material until an approval is obtained The facility did not meet the requirement to apply for a renewal of the Treatment and Processing Notification. Mr. Bilbro stated that the business filed for bankruptcy and his attorney advised him to not re -file paperwork under the company _ name. AREAS OF CONCERN AND COMMENTS: On June 19, 2009, John Patrone and Jason Watkins met with Gary Bilbro and conducted a comprehensive audit of the Land Clearing Debris Treatment and Processing Notification Facility located at 2394 W. Clemmonsville Road in Winston-Salem, Forsyth County. 1. The Innovative Recycling Services, Inc. facility is located at the closed Vulcan Materials, Inc. South Fork Quarry. The property is owned by Vulcan Lands, Inc. and remains under lease to Innovative Recycling Services, Inc. which is now bankrupt according to Gary Bilbro, former President. 2. The facility's Notification expired June 1, 2008. The company was notified in the January 27, 2009 audit report that it was required to renew the notification within 30 days or remove. all processed and unprocessed material from the property by June 1, 2009. 3. Attempts were made by Section staff to contact Innovative Recycling personnel to determine the status of the site, however all phones listed for the company had been disconnected. And on April 6, 2009, a voicemail message was left at Mr. Bilbro's residence regarding the status of the company but was not returned. 4. A site visit was conducted on June 8, 2009. The facility was closed (entrance gate closed, secured with a lock). On June 16, 2009, Mr. Patrone contacted Vulcan Materials, Inc. — Land Manager, Mickey Love (336-744-2021) to inquire about accessing the site in order to verify if Innovative Recycling Services, Inc. had removed the material. On June 16, 2009, Mr. Bilbro contacted the SWS (notified of SWS inquiry by Vulcan Materials, Inc.) regarding the T&PN and agreed to meet SWS personnel -on -site June 19, 2009. 5. Mr. Bilbro stated that he no longer wants to operate the T&PN and is in the process of negotiating terms for the removal of material on -site (processed and unprocessed land clearing debris, mulch, leaves, and pallets). 6. The facility appeared to have greater than 10,000 yd3 of processed and unprocessed material on -site. Mr. Bilbro stated that he has been able to remove only a small amount of material. Essentially, the same amount of material that was present on -site during the last audit, conducted January 27, 2009, is still on -site. 7. The material on -site consists of several piles of single ground mulch, three piles of leaves, numerous piles of land clearing debris, and three piles of pallets. Mr. Bilbro was informed that the facility's Notification required that he not receive low carbon nitrogen ratio materials. 8. Mr. Bilbro stated that current negotiations to have the material on -site removed appear promising and that, if the negotiations are successful, the material could be removed in ninety (90) days. Mr. Bilbro is in negotiations with NatureWorks, LLC which plans to use the site to pre -compost material for verma compost activities. 9. The facility must contact North State Waste and have the roll -off containers that contain solid waste removed from the site. 10. Mr. Bilbro was reminded to have the scrap tires on -site hauled to an approved solid waste disposal facility. 11. Mr. Bilbro was informed that he must have the material on -site removed (both processed and unprocessed) and maintain hauling receipts for material disposed of at approved solid waste disposal facilities and/or sales receipts for material sold.
