You are hereby advised that, pursuant to N.C.G. S. 130A-22, an administrative penalty of up to $15,000 per day maybe assessed for each violation of
the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction
from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve
compliance with the North Carolina Solid Waste Management Act and Rules.

STATUS OF PAST NOTED VIOLATIONS:
NONE
AREAS OF CONCERN AND COMMENTS:
1. Capital City Landscape Supplies, Inc. is operating a yard waste collection and processing facility at 2917
Gresham Lake Road in Raleigh, NC on property owned by Dianne Thompson et al and Rex & Carol Everhart,
Wake County Deed Book, 07995, Page 0402.
2. On January 27, 2010, Jason Watkins, Central District Supervisor — Field Operations met with Mirek Chromy
and Tony Sneberg to conduct a comprehensive inspection of the facility.
3. The yard waste facility shares an entrance with an auto repair/salvage business located on the same property.
The yard waste storage and processing area currently occupies between 1-1.5 acres of the 7+ acre parcel along
the eastern side of the property. A gated entrance is in place and signage noting the facility name, type and
waste acceptance policies was observed.
4. The facility also buys and sells various types of mulch and other landscaping supplies out of a retail sales area
adjacent to the site entrance.
5. The facility is currently accepting land clearing debris, leaves and other yard trash (grass clippings, shrubbery,
etc). The land clearing debris is stored near the rear of the property for processing. Leaves and other debris
are stored separately closer to the site entrance, but are not being processed. Leaves and other debris are being
stored (unprocessed) and sold along with the processed land clearing debris to O1dCastle Lawn and Garden in
Louisburg, NC. No active composting is occuring at this time as noted would be implemented in the
submitted and approved Yard Waste Notification.
6. Spoke via phone with Matt Rizzuto (919-497-5505) at OldCastle Lawn and Garden, 8153 NC Hwy 56
Louisburg, NC 27549. They take the material from the Gresham Lake Road property to their facility where it
is processed and mixed into a topsoil building mixture. According to Mr. Rizzuto, no composting of the yard
trash material is occuring at his facility and they do not hold any Section issued approvals to compost.
7. By accepting leaves and yard trash at this site, composting of those materials is required prior to them leaving
the site, unless they are going to a receiving facility where they will be composted in accordance with the rules
codified under 15A NCAC 13B .1406. Within 15 days of receipt of this report, either cease acceptance of
those waste types or begin a composting and monitoring operation that ensures materials leaving the site have
met the minimum temperature requirement of 131 degrees Fahrenheit for a period of 3 consecutive days. If
you choose to cease acceptance, then all piles of leaves, etc must be removed from the property to a facility
permitted by the Section to manage them. Receipts from the receivingfacility shall be submitted to the
Section.
8. Per 15A NCAC 13B .1404(a)(2), a minimum buffer of 5Oft is required to be maintained between all waste
piles and all property boundaries. It appeared that the unprocessed waste piles on site are encroaching into
that 50ft buffer. Within 15 days of receipt of this report, ensure all material piles (unprocessed and processed)
meet this requirement. It is suggested that the property line be clearly marked along the eastern property
boundary and that permanent markers be put into place to designate the 50 ft buffer.

9. If the above actions are not taken within the noted deadlines, the facility is subject to enforcement action for
violations of the NC Solid Waste Management Rules, including revocation of notification and civil penalty
assessment of up to $15,000 per day per violation.
10. As a reminder, the yard waste notification for this site must be renewed annually by June 1st
