OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0201
(a) No person shall treat, process, store, or dispose of solid waste or arrange for the treatment, processing, storage or disposal
of solid waste except at a solid waste management facility permitted by the Division for such activity, except as provided in
G.S. 130A-294(b).
(b) No person shall cause, suffer, allow, or permit the treatment, storage, or processing of solid waste upon any real or personal
property owned, operated, leased, or in any way controlled by that person without first obtaining a permit for a solid waste
management facility from the Division authorizing such activity, except as provided in G.S. 130A-294(b).

(c) No solid waste management facility shall be established, operated, maintained, constructed, expanded or modified
without an appropriate and currently valid permit issued by the Division. It is the responsibility of every owner and operator
of a proposed solid waste management facility to apply for a permit for the facility. The term 'owner" shall include record
owners of the land where the facility is located or proposed to be located and holders of any leasehold interest, however
denominated, in any part of the land or structures where the facility is located or proposed to be located.
The facility is being run without a permit or a notification.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. Pursuant to 15A NCAC 13B .1402(g)(3), the owner or operator of any Type 1 Yard Waste Facility which
occupies less than two acres of land and, processes and stores less than 6,000 cubic yards of material quarterly
shall submit a Yard Waste Notification form to the Division of Waste Management, Solid Waste Section by
June 1st of each year. Tony Hammond, Ahoskie Town Manager, stated that he did not realize that a
Notification must be submitted yearly by June 1 st. He stated that he would submit paperwork immediately.
2. There are many plastic bags in with the yard waste. These and any other incidental waste must be removed
from the yard waste on a frequent basis and either put in a waste container at the site to be properly disposed
of at a permitted facility or removed from the site and ultimately be disposed of at a permitted facility.
3. Permanent, easily visible edge of waste markers must be placed at the site indicating the less than two acres of
the notification. No yard waste is to be placed outside of these markers.
4. All of the rules on the Yard Waste Notification form must be followed including setbacks and amount of final
product at the Notified Site. It does not appear that much of the old `broken down' yard waste has been
removed from the Notified site.
5. The site must be graded to prevent waste standing in water.
6. The gate at the entrance to the site should be kept locked in order to prevent any illegal dumping at the site.
7. 15A NCAC 13B .1406 (8) Sign Requirements states:
(A) Signs providing information on waste that can be received, dumping procedures, the hours during which
the site is open for public use, the permit number and other pertinent information shall be posted at the site
entrance.
(C) Signs shall be posted stating that no hazardous waste, asbestos containing waste, or medical waste can be
received at the site.
There was not a sign at the entrance of the Yard Waste area. Other pertinent information would include an
emergency contact.
