OBSERVED VIOLATIONS:
15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ration of three
horizontal to one vertical at any time."
Waste appears to have been pushed into the tree line surrounding the clearing. The northern, eastern, and western side
slopes were identified to be nearly vertical. Several dead trees were identified along the eastern side slope. The waste
needs to be moved away from the tree line and properly compacted and sloped.

Unacceptable wastes, such as plastic bottles, tires, treated wood, were found throughout the facility. The unacceptable
wastes must be removed and properly disposed of.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
A copy of the new LCID rules, which became effective on January 1, 2021, are provided with this report. Please
read through the rules and contact me if you have any questions. Based on rule 15A NCAC 13B .0563 (6), within
5 years of the effective date, notified LCID landfills will need to be properly closed or obtain a permit from the
Division of Waste Management.
1. The access road is of all-weather construction and appears to be properly maintained.
2. The gate was not locked at the time of this inspection.
3. Edge of waste markers were not visible, and the actual disposal area could not be determined during this
inspection. The facility is located somewhere within a 5-acre clearing. Permanent, clearly visible edge of waste
markers must be established at the site, showing the under two (2) acres boundary for waste disposal.
4. An area with lime residue and several animal bones were identified to the west of the entrance road. Dead
animals are not permitted for disposal at a notified LCID. It is recommended that you contact the North Carolina
State Veterinarian (02 NCAC 52C .0102 Disposal of Dead Animals) on the proper guidance for the management
and/or disposal of dead animals or transport them to a facility permitted to receive them for disposal.
5. Vegetation of the LCID is overgrown and should be mowed to allow for proper inspection.
6. 15A NCAC 13B .0566 (8) "Surface water shall be diverted from the working face and shall not be
impounded over waste." Several areas of standing water were observed along the entrance roadway. The areas
need to be repaired and graded to shed water, so that there is no standing water over waste.
7. Digital pictures were taken during the inspection.
8. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be
completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up
inspection in 30 days to ensure issues noted in this inspection report have been addressed.
