For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. STATUS OF PAST NOTED VIOLATIONN: None AREAS OF CONCERN AND COMMENTS: On October 25, 2010, John Patrone met with Richard Newsome to conduct a comprehensive audit of the SOAR LLC Land Clearing Debris Treatment and Processing Notified Facility located on Newsome Road in King, Stokes County. 1. Mr. Newsome stated that the facility has recently begun accepting land clearing debris (LCD). The facility has not ground LCD to date but plans to grind material twice a year in the spring and fall. 2. The facility maintains records of the amount of material received. Billing receipts were verified. Mr. Newsome stated that there is — 2600 yd3 of LCD on site. It is recommended that the facility tally the quantity of material on site (unprocessed and stored) quarterly and denote the origin of material received on receipts. 3. The facility shall not process or store more than 6,000 yd3 of material per three month period, or have on hand at any one time a combination of waste material and finished product that exceeds 6,000 yd3. 4. The facility is located at Smart Onsite Aggregate Recycling LLC (SOAR LLC) and accepts and sells concrete, asphalt, gravel, brick, rock, clean soil, LCD, and mulch. Mr. Newsome stated that he plans to grind inert debris. 5. Mr. Newsome was reminded to maintain adequate fire lanes between the T&PN operation and other operations associated with SOAR LLC conducted on the site. 6. Mr. Newsome is reminded to ensure adequate area is available for T&PN operations apart from other SOAR LLC operations. 7. The facility stores mulch for sale in bins adjacent to Newsome Road near the entrance to the property — 200 feet from the T&PN operation. Land clearing debris ground at the T&PN may be stored in the mulch storage bins and be considered "off -site" in terms of quarterly totals. 8. The facility is reminded that it shall not conduct compost operations. 9. The facility is reminded that it shall not accept individual loads of leaves, grass, or green material. 10. The facility has recently accepted material from the Burcham illegal dump (IS860902). The LCD accepted has been unearthed. Mr. Newsome stated that loads are — 80% soil to 20% LCD. 11. The facility appeared to meet all required setbacks. 12. There was no indication of erosion or runoff. 13. The facility is actively constructing a gate to secure the site. 14. The facility has proper signage. 15.
