Comprehensive audit of new Treatment and Processing Notification
NOTICE OF VIOLATION(S):
None
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of
the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction
from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve
compliance with the North Carolina Solid Waste Management Act and Rules.

AREAS OF CONCERN AND COMMENTS:
1. Facility is a notified treatment and processing owned by VIP Grading, Inc. As a notified treatment and
processing facility the following types of waste may be accepted for processing: land clearing waste; such as
stumps, tree trunks, limbs and leaves; high carbon -nitrogen yard trash that results from landscaping and yard
maintenance activities. Grass clippings and other similar materials (green wastes) with low carbon -nitrogen
ratios man not be received.
2. The material observed on -site consisted of stumps, trees and limbs.
3. All siting criteria appear to be met at the property. Please remember that a 50 foot buffer must be maintained
between the operational area and the property line.
4. At the time of this inspection there was less than 6000 cubic yards of material at the facility. Please keep in
mind that processing more than 6000 cubic yards of material in three months is not allowed with this
notification. Also, the maximum amount of material allowed to be on site at any given time is also 6000 cubic
yards. This limit includes both raw material and finished product.
5. A record should be kept of the amount of material accepted and the amount of product produced and
distributed. This information is required on the annual report due to the Solid Waste Section by June ls` of
each year.
6. A pile of soil was also observed on the property. Mr. Miles confirmed in a later phone call that he is
stockpiling soil for possible later use. The stockpiling of uncontaminated soil is not a concern to the Solid
Waste Section as long as the stockpile is in a separate and distinct area from the storage of any raw or finished
material brought to the facility. Please note that the State Division of Land Resources or Durham County
Department of Engineering and Environmental Services/Erosion Control Division may have additional
requirements and/or require a permit for this activity.
