(on site 07/26/11 and via cell phone 08/17/11) STATUS OF PERMIT: Land Clearing Debris Treatment and Processing Facility Notification application received by the SWS on May 23, 2011 Land Clearing Debris Treatment and Processing Facility Notification approval letter issued by the SWS, dated June 10, 2011 Land Clearing Debris Treatment and Processing Facility Notification expires annually June I" PURPOSE OF SITE VISIT: Comprehensive Audit (to ensure that the Land Clearing Debris Treatment and Processing Facility (T&PN) is in compliance with 15A North Carolina Administrative Code (NCAC) 13B, Section .0300, with the guidelines of the Land Clearing Debris Treatment and Processing Notifications included as part of the Land Clearing Debris Treatment and Processing Facility Notification Form, and information provided on the facility site plan and notification form) STATUS OF PAST NOTED VIOLATIONS: NA FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 OBSERVED VIOLATIONS None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITONAL COMMENTS On July 26, 2011, John Patrone and Robert Hearn met with Mark Moldenhauer to conduct a comprehensive audit of the Moldenhauer T&PN Facility on Lystra Road in Chapel Hill, Chatham County. 1. The location of the land clearing debris treatment and processing (T&PN) facility is atop a land clearing and inert debris (LCID) landfill (N0193) that will no longer be operated. 2. Mr. Moldenhauer stated that he will no longer utilize the LCID landfill but will grind material atop the landfill cap/area. The LCID landfill has not been closed -out but appears to meet the requirements for closure. 3. During the site visit all LCID material was covered with soil and the site/landfill area graded accordingly. 4. A small amount of land clearing debris (LCD) was on site of which Mr. Moldenhauer stated will be stored and ground as per the requirements of the T&PN. 5. Mr. Moldenhauer stated that he will readily stockpile LCD and grind material but was unsure of the rate of material acceptance and when material might be ground. 6. On August 17, 2011, Mr. Patrone spoke with Mr. Moldenhauer regarding the pace of LCD collection/stockpile and when grinding may be expected. Mr. Moldenhauer stated that he expects to have enough LCD to grind by early winter 2011. Please contact me if you have any questions or concerns regarding this inspection report.
