On August 9, 2011, a site inspection was conducted at the Monticello Cross Roads facility location. Material, both processed and stored, was present at the site in large quantities. The (typically) manned information but had been FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 removed. No signage for the facility remained. It appeared as though the treatment and processing operations had been abandoned. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITONAL COMMENTS 1. A site inspection was conducted to determine if the facility was still in operation. Notification with the Section had not been received by the June 1, 2011 deadline and no "Cease of Operation Form" was on file with the Section. The property had been recently sold to Riverside Stump Dump (Clara and Ronnie Ray) and the lease agreement allowing Monticello Crossroads facility to operate on the site had been terminated (per C. Ray). 2. Material was staged in multiple windrows. Most of the material was un-ground land clearing debris piled approximately 6 to10-feet high. Adequate access between windrows had been maintained. No unacceptable wastes were noted co -mingled with the storage piles. The site had been conditionally approved as a Temporary Disaster Debris Staging area (DS 11-007). At this time, as the operations and ownership of the property have altered from the original application, the conditional approval for use of this site to stage/store Disaster Debris has been rescinded. 4. To continue the grinding and management of this material you must immediately submit current Notification paperwork to the Section. To establish that the facility is closed and will no longer operate, you must remove and properly manage all land clearing materials/mulch stored at the facility and submit the "Cease of Operation" form to the Section (located: http://portal.ncdenr.org/web/wm/sw/tandpnotifications ). Failure to do so may result in the classification of the facility as an "open dump" in violation of 15A NCAC 13B .0201 Rule.
