Initial site visit and compliance inspection.

OBSERVED VIOLATIONS
1. The grinder is located approximately 150-ft. from the Bennick Grading & Excavation maintenance shop. Please
ensure that the following required set -backs for the facility are maintained:
50 feet from the waste boundary to all surface waters of the state as defined in G.S.
143-212 and all property lines.
200 feet from the treatment and processing area to residential dwellings and
commercial or public buildings.
0 100 feet from water supply wells.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. Access to the facility is controlled with a gate and fencing.
2. The operational area is approximately 2.0-acres.
3. No prohibited wastes were observed. The grinding materials come from land clearing operations.
4. Please ensure that the un-processed land clearing debris and the finished product (mulch) are both stored in
reasonable sized piles or windrows.
5. The facility owns their grinder.
6. The operational area is relatively flat, well graded and surrounded by berms on all four sides.
7. Please ensure that no instances of standing water occur on the site.
8. Please ensure that adequate erosion control measures, devices, or structures are maintained to control runoff
and to prevent silt from leaving the site and to prevent excessive on -site erosion.
9. Some leachate was observed at the base of two piles of mulch. This leachate was properly contained on site.
10. There are hand-held fire extinguishers on site.
11. The Nebo Volunteer Fire Department is available for emergency response as needed.
12. The facility is served by a municipal water system.
13. The facility is very clean and well organized.
