STATUS OF PERMIT: Land Clearing Debris Treatment and Processing Facility Annual Notification application received by the SWS on May 11, 2011 Land Clearing Debris Treatment and Processing Facility Annual Notification approval letter issued by the SWS, dated May 25, 2011 Land Clearing Debris Treatment and Processing Facility Annual Notification expires on June 1 of each year FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 PURPOSE OF SITE VISIT: Comprehensive Audit (to ensure that the Land Clearing Debris Treatment and Processing (T&PN) Facility is in compliance with 15A North Carolina Administrative Code (NCAC) 1313, Section .0300 and with the Land Clearing Debris Treatment and Processing Notifications Guidance included as part of the Land Clearing Debris Treatment and Processing Facility Annual Notification Form) STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS On December 15, 2011, John Patrone met with Chris Mcghee and Trent Satterfield to conduct a comprehensive audit of the Gorilla Materials, Inc. Land Clearing Debris Treatment & Processing Facility on Mount Hermon Church Road in Durham, Orange County. 1. The facility is a concrete, brick, asphalt, soil, and land clearing debris (LCD) treatment and processing facility. 2. The facility is open Monday through Friday, 7:00 am to 5:00 pm and Saturday and Sunday by appointment. 3. Material is received and stored, prior to processing, in designated areas of the lot. Clients off-load material to the appropriate area based on specific load -type. 4. After material has been processed it is stored in loading bays, constructed of large cement blocks, near the facility entrance. The processed material storage bay area is where customers load -up material. 5. All material is processed on site. Concrete, brick, and asphalt are crushed, soil is either sold as fill/compactable dirt or screened topsoil, and LCD is ground twice prior to sale as mulch. 6. The facility does not use a vehicle scale. Material is priced per vehicle type ranging from pickup trucks @ $20.00 to dump trailers > 24 feet @ $110. 7. The pile of LCD, processed and unprocessed, on site was — 300' x 15' x 12'. The material is stored in a windrow adjacent to the access road. 8. The facility began accepting material May 2011. Mr. Mcghee stated that he hauled most of the LCD to the facility (-10 — 12 tractor trailer loads, each weighing —90 — 100 yd3). There is an estimated 2,200 yd3 of unprocessed and processed LCD on site. 9. The facility shall ensure that records are maintained verifying the amount of unprocessed and processed material on site, per quarter. 10. The facility has —650 yd3 of concrete, —600 tons of asphalt, and —8,000 yd3 of soil on site. 11. There are five yard hydrants at the facility for immediate response to an emergency and for dust control. The Eno Fire Department will address a fire/other at the facility. 12. Appropriate fire lanes are maintained. 13. The facility appeared to meet required setbacks. 14. There was no indication of erosion or runoff. 15. Access roads are of all-weather construction. 16. The facility is secured by a locked chain link fence. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 17. Facility personnel are on site during operating hours and an employee lives in a mobile home adjacent to the entrance gate. 18. The facility has proper signage. 19.
