Wommack LCID Permit # N0616 300 West 101" Street Weldon, North Carolina GPS (decimal degrees): Lat: 36.420259' Long:-77.606748' Dear Mr. Wommack, On April 1, 2021, Amanda Thompson, Environmental Senior Specialist, and Drew Hammonds, Eastern District Supervisor, with the State of North Carolina, Division of Waste Management Solid Waste Section (Section), inspected the above referenced facility for compliance with North Carolina solid waste statutes and rules. The following violation(s) were noted: A. 15A NCAC 13B .0566 (1), "The site shall only accept those solid wastes that it is permitted to receive." Mr. Job S. Wommack, the Job S. Wommack LCID, is in violation of 15A NCAC 138.0566 (1) in that construction and demolition (C&D) wastes, including asphalt shingles, engineered wood and plastics, were identified within the waste stream. B. 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time." Mr. Job S. Wommack, the Job S. Wommack, is in violation of 15A NCAC 138 .0566 (2) in that waste has not been compacted as densely as practical or restricted to the smallest feasible area. Mr. Job S. Wommack, the Job S. Wommack LCID, is in violation of 15A NCAC 138.0566 (3) in that adequate earthen material had not been applied to cover all the exposed solid waste. It appeared at the time of this inspection, that the waste has not been covered. The covering of waste was discussed in the April 7, 2011, July 27, 2015, and January 5, 2016 inspection reports D. 15A NCAC 13B .0564 (6) (b), "The facility shall meet the following buffer requirements ... 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells." Job S. Wommack, the Job S. Wommack LCID, is in violation of 15A NCAC 138.0564 (6) (b) in that waste is within 100 feet of a residential property, located on PIN 1200146, which is landlocked by the parcel occupied by the LCID. Based upon the foregoing, Mr. Job S. Wommack and the Job S. Wommack LCID shall come into compliance by June 16, 2021 with all requirements of the regulations in 15A NCAC 13B .0566 (1), 15A NCAC 13B .0566 (2), 15A NCAC 13B (3) and 15A NCAC 13B (6) (b) by completing the following: 1) Cease accepting waste at this site until conditions of compliance are met. 2) Contact Amanda Thompson at (910) 433-3353 or amanda.thompson@ncdenr.gov prior to beginning any cleanup operation to discuss proper documentation and procedures. 3) Remove any non -conforming waste from the waste stream and properly dispose of at a permitted facility. Disposal tickets from a properly permitted disposal facility for the non -conforming waste should be maintained and copies provided to Amanda Thompson. (Please note that burning of the waste is prohibited and would be a violation of the North Carolina Air Quality Rules). 4) Densely compact the waste and restrict the waste to the smallest feasible area. 5) All areas of exposed waste must be covered with no less than six inches of soil. 6) In order to meet the 100-foot buffer requirements, Mr. Wommack must move the waste away from the residential property located on PIN 1200146. 7) Ensure that Edge of Waste Markers are in place and visible one to the next. 8) Prevent unauthorized entry to the site by means of gates, berms, or fences and post signs indicating that the site is closed, and no dumping is allowed. Mr. Job S Wommack and the Job. S. Wommack LCID shall provide a written certification with supporting documentation on company letterhead confirming the noted compliance schedule has been completed. Include in this certification any actions taken to prevent these violations from occurring in the future. The written certification with supporting documentation should be mailed to the following address. Wommack and the facility, in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this activity. Be advised that pursuant to G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please keep me informed during the solid waste removal process. This office will conduct follow- up inspections in order to verify your progress. Upon completion, a final inspection will be conducted to verify that the removal of solid waste has been completed per the requirements of this Notice of Violation.
