Current status of the Land Clearing and Inert Debris Landfill Notification is OPEN
PURPOSE OF AUDIT:
Compliance Audit (to ensure that the notified Land Clearing and Inert Debris (LCID) landfill is in compliance with 15A
North Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566)
NOTICE OF VIOLATION:
None
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of
the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction
from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve
compliance with the North Carolina Solid Waste Management Act and Rules.

STATUS OF PAST NOTED VIOLATION(S):
None
AREAS OF CONCERN AND COMMENTS:
On February 3, 2011, John Patrone met with Randall Baker and Steve Gomes to conduct a comprehensive audit of the
Abbey Green, Inc. and Overdale Holdings, Inc. Notified LCID Landfill on Overdale Road in Winston-Salem, Forsyth
County.
1. The LCID landfill footprint is estimated to be 1/8 acre in size.
2. Ensure that LCID material is adequately (completely) covered with soil monthly.
3. The LCID landfill is required to comply with 15A NCAC 13B .0564(9)(b), "The facility shall meet the following
buffer requirements: 100 feet from the disposal area to property lines, residential dwellings, commercial or public
buildings, and wells."
4. The LCID landfill property PIN # and book and page numbers are incorrect on the LCID landfill notification form.
Mr. Baker, via email dated 02/09/11, stated that the correct property PIN # is 6833-52-1826.00 and that the facility
intends to record a letter with the (Forsyth County) Register of Deeds to correct the Notification. Ensure that a
copy of the corrected LCID landfill notification is given to SWS.
5. Mr. Baker stated, via aforementioned email, that the LCID landfill lot has been combined with the adjacent Abbey
Green, Inc. and Overdale Holdings, Inc. Transfer, Recycle, Resource Recovery and Processing Facility (34-24) lot
such that both operations occur on one parcel of land. Ensure that a copy of the survey plat, prepared by a licensed
surveyor, is given to the SWS depicting the single parcel of land and all applicable setbacks per 13B .0564(9)(b).
6. The adjacent Transfer, Recycle, Resource Recovery and Processing Facility stores inert debris atop the LCID
landfill area at the front of the lot, set back from landfill operations. Mr. Baker, via aforementioned email, stated
that a row of (large) concrete blocks have been installed to delineate between the inert debris storage area and
LCID landfill operation area.
7. It is suggested that the facility place permanent markers depicting the 100 foot buffer area from the edge of waste
to buildings, etc. per 13B .0564(9)(b). Mr. Baker, via aforementioned email, stated that the facility will install
markers indicating required setbacks.
8. No indication of erosion or runoff was observed.
9. Access roads are of all-weather construction.
10. The facility has proper signage.
11. The facility is secured by locked gate and personnel are on the property during business hours.
