Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The Septage Detention and Treatment facility (SDTF) consisted of one above ground 12,000-gallon carbon steel tank and two 20,000 gallon frac tank for a total capacity of 52,000 gallons for the storage of domestic septage and grease septage. 2. A 20,000 gallon frac tank was observed with no leaks or spills observed. A second 20,000-gallon tank was not observed. A 20,000 gallon frac tank was also observed; however, this is only used for oil and water separation and not grease. As long as this item does not contain septage grease then it does not need to be included in the permit. 3. The 12,000 tank was observed in good condition with no leaks or spills observed (see below). 4. State regulations require a “No Trespassing” sign at the entrance to a facility, can also be located on the tanks themselves. 5. The access road to the facility was well maintained. 6. The tanks appeared to be structurally sound and well maintained. 7. The permit is currently issued to Chris Withers, who is no longer with the company. A permit revision is necessary to reflect the current facility contact.
