Dear Bill:
On behalf of 3412 Monroe Road Partners, LLC, Hart & Hickman, PC (H&H) is submitting
documentation of public notice completed for the Kroehler Manufacturing Brownfields
agreement. Enclosed please find the following:
• Affidavit of Publication of the Summary of Notice of Intent to Redevelop a Brownfields
Property which was published in the Charlotte Observer on March 17, 2021;
• Emails documenting delivery of the full Notice of Intent to Redevelop a Brownfields
Property to the Mecklenburg County Health Department, Charlotte Mecklenburg
Library, and public officials on March 23, 2021;
• Certified mail return receipt green cards for delivery of the Summary of Notice of Intent
to Redevelop a Brownfields Property to adjacent property owners which were sent on
March 17, 2021; and
• Photographs of the Public Notice posting of the Summary of Notice of Intent to Redevelop
a Brownfields Property which were posted at the site on March 17, 2021.

H&H received green card receipts from all the adjacent property owners with the exception of
two letters, which were returned to H&H. The letter sent to Seaboard Coastline Railway Co. was
returned as a vacant address location and the letter sent to Ziad & Adnan Nasrallah was returned
as attempted delivery but unable to forward.
Please note that a copy of the Notice of Intent to Redevelop a Brownfields Property was not hand
delivered to the Charlotte Mecklenburg Library for viewing as this requirement has been waived
by the North Carolina Department of Environmental Quality Brownfields Program due to
concerns associated with COVID-19. However, as noted in the response from Caitlin Moen, the
library director, that the Notice of Intent to Redevelop a Brownfields Property would be posted at
the Plaza Midwood location.

intends to redevelop Kroehler Manufacturing site located at 3412 Monroe Road in Charlotte,
Mecklenburg County under the North Carolina Brownfields statute, known as the Brownfields
Property Reuse Act of 1997, N.C.G.S. § 130A-310.30 et seq. The Brownfields Act requires that we
provide you with certain materials concerning this project and also requires that we provide
documentation to the North Carolina Department of Environmental Quality (DEQ) Brownfields
Program confirming that we have fulfilled this requirement on behalf of the developer. Typically, we
hand deliver these materials to your office. However, due to the current concerns associated with
COVID-19, we have elected to provide them to you via email.
