GlaxoSmithKline(Monsanto)(#22059-18-032)LURUpdateLUR2:TheBrownfieldsPropertymaynotbeusedforchildcare,adultcarecentersorschoolswithoutthepriorwrittenapprovalofDEQ.lIncomplianceElOutofcomplianceRemarks:Thepropertyisnotusedforchildcarecenters,adultcarecenters,orschools.LUR3:PhysicalredevelopmentoftheBrownfieldsPropertymaynotoccurotherthaninaccord,asdeterminedbyDEQ,withanEnvironirientalManagementPlan(“EMP”)approvedinwritingbyDEQinadvance(andrevisedtoDEQ’swrittensatisfactionpriortoeachsubsequentredevelopmentphase)thatisconsistentwithalltheotherlanduserestrictionshereinandthosepreviouslyrecordedandattachedasExhibit3totheAgreement,anddescribesredevelopmentactivitiesattheBrownfieldsProperty,thetimingofredevelopmentphases,andaddresseshealth,safetyandenvironmentalissuesthatmayarisefromuseoftheBrownfieldsPropertyduringconstructionorredevelopmentinanyotherform,includingwithoutlimitation:a.soilandwatermanagementissues,includingwithoutlimitationthoseresultingfromcontaminationidentifiedintheEnvironmentalReports;b.issuesrelatedtopotentialsourcesofcontaminationreferencedinExhibit2totheAgreement;c.contingencyplansforaddressing,includingwithoutlimitationthetestingofsoilandgroundwater,newlydiscoveredpotentialsourcesofenvironmentalcontamination(e.g.,USTs,tanks,drums,septicdrainfields,oil-waterseparators,soilcontamination);d.contingencyplansrelatedtosamplingandmanagingsoil,groundwaterandsurfacewaterrelatedtotheinstallationormaintenanceofstormwaterdrainlinesorwalkingtrails;ande.plansforthepropercharacterizationof,andasnecessary,disposalofcontaminatedsoilsexcavatedduringredevelopment.iIncomplianceElOutofcomplianceRemarks:RedevelopmentplansareongoingandbeingconductedinaccordancewiththeDEOBrownfieldsapprovedEnvironmentalManagementPlandatedMay31,2019andrevisedSeptember2.2020.LUR4:GroundwaterattheBrownfieldsPropertymaynotbeusedforanypurposeotherthanextracting,amendingwithinjectant,andreinjectingintotheaquiferundertheauthorityofDEQInjectionPermitWI0501044,withoutthepriorwrittenapprovalofDEQ.(XlIncomplianceElOutofcompliance GlaxoSmithKline(Monsanto)(#22059-18-032)LURUpdateRemarks:GroundwaterattheBrownfieldspropertyisnotbeingusedforanypuoseotherthanRCRAcorrectiveactionactivitiesunderGlaxoSmithKline’sRCRAPermitNCD052547635andDEOInjectionPermitWI0501044.LUR5:DuringBrownfieldsPropertyuse,thethenownershallmaintainthecurrentsoilcoverof18inchesatSWMU12and24inchesatSWMU13(SMWUsasdenotedontheplatcomponentoftheNoticeofBrownfieldsProperty),aswellasadequatevegetativegrowthtopreventerosiononthoseSWMUs.AnymodificationoralternativetothecoverorcapthatispresentasoftheeffectivedateoftheAgreementmustbepreapprovedinwritingbyNCHazardousWasteSectionandNCBrownfieldsProgram.Thethenownershalleffecttherepairofanybreachesorerosionthatimpairtheintegrityofthesecoveredorcappedareas.Saidrepairsmustbeinitiatedwithin72hoursoftheirdiscoveryper40CFR76161(a)(7).SaidrepairsshallbenotedintheLandUseRestrictionupdatedescribedinLUR15below.1IncomplianceDOutofcomplianceRemarks:TheareasattheBrownfieldspropertyidentifiedasSWMU-12andSWMU-13ontheplatcomponentoftheNoticearecurrentlycappedwithsoilinaccordancewithLUR5.Inspectionsofthesoilcapsarebeingcompletedonanannualbasis.ThemostrecentinspectionactivitiesaredocumentedinanAnnualSoilCapInspectionreportpreparedbyHart&Hickman,PC(H&H),datedJanuary15,2021.LUR6:NosoilimpactedbyPCBsasdenotedontheplatcomponentoftheNoticeofBrownfieldPropertyshallbedisturbed,moved,ordisposedofwithoutwrittenapprovalfromtheNCHazardousWasteSectionandtheNCBrownfieldsProgram,andnosoilmayberemovedfrom,orbroughtonto,theBrownfieldsPropertywithoutpriorsamplingandanalysistoDEQ’ssatisfactionandthewrittenapprovalofDEQ,unlessconductedinaccordancewithanapprovedEMPasoutlinedaboveinLUR3.IncomplianceDOutofcomplianceRemarks:RedevelopmentactivitiesattheSitearebeingconductedinaccordancewiththeDEQBrownfieldsapprovedEMPdatedSeptember2,2020.LUR7:NooccupancyofanynewlyconstructedbuildingontheBrownfieldsPropertymayoccuruntilthethenowneroftheBrownfieldsPropertyconductsrepresentativefinalgradesoilsamplingofareasthatarenotcoveredbybuildingfoundations,sidewalks,orasphalticorconcreteparkingareasanddrivewayspursuanttoaplanapprovedinwritingbyDEQ.1IncomplianceDOutofcompliance GlaxoSmithKline(Monsanto)(#22059-18-032)LURUpdateRemarks:Finalgradesamplingwillbeconductedpriortooccupancyoffuturebuildings.LUR8:NoenclosedbuildingmaybeconstructedontheBrownfieldsPropertyandnoexistingbuilding,definedasthosedepictedontheplatcomponentoftheNoticeofBrownfieldsProperty,maybeoccupieduntilDEQdeterminesinwritingthat:a.thebuildingisorwouldbeprotectiveofthebuilding’susers,publichealthandtheenvironmentfromriskofvaporintrusion,includingmethanegeneratedfromtheremediationofgroundwater,basedonsiteassessmentdataorasite-specificriskassessmentapprovedinwritingbyDEQ;b.thebuildingisorwouldbesufficientlydistantfromtheBrownfieldsProperty’sgroundwaterand/orsoilcontaminationbasedonassessmentdataapprovedinwritingbyDEQthatthebuilding’susers,publichealthandtheenvironmentwillbeprotectedfromriskfromvaporintrusionrelatedtosaidcontaminationormethanegeneratedfromtheremediationofgroundwater;orc.vaporintrusionmitigationmeasuresaredesigned,installed,andimplementedinamannerthatwillfullyprotectpublichealthtothesatisfactionofaprofessionalengineerlicensedinNorthCarolina,asevidencedbysaidengineer’sprofessionalsealonareportthatincludesphotographsandadescriptionoftheinstallation,qualityassurancetestingprocedures,andperformanceofsaidmeasures,andtoDEQ.AnydesignspecificationandqualityassurancetestingproceduresforvaporintrusionmitigationmeasuresshallbeapprovedinwritingbyDEQinadvanceofinstallationand/orimplementationofsaidmeasuresandprocedures.1IncomplianceDOutofcomplianceRemarks:VaporintrusionassessmentactivitieshavebeencompletedattheSiteandaredocumentedinH&H’sSeptember25,2019BrownfieldsAssessmentReportandSeptember16,2020AdditionalBrownfieldsAssessmentReport.InaletterdatedOctober6,2020,DEOBrownfieldsprovidedwrittenconcurrencethatproposedbuildingslocatedinthePhase1redevelopmentareareferencedintheaforementionedreportsareincompliancewithLUR8.LUR9:ByJanuary31stannuallyaftertheeffectivedateoftheAgreement,foraslongasphysicalredevelopmentoftheBrownfieldsPropertycontinues(exceptthatthefinaldeadlineshallfall90daysaftertheconclusionofphysicalredevelopment),thethenowneroftheBrownfieldsPropertyshallprovideDEQareportsubjecttowrittenDEQapprovalonenvironment-relatedactivitiessincethelastreport,withasummaryanddrawings,thatdescribes:a.actionstakenontheBrownfieldsPropertyinaccordancewithSectionV:WorktobePerformedabove,including;b.soilgradingandcutandfillactions;c.methodology(ies)employedforfieldscreening,samplingandlaboratoryanalysisofenvironmentalmedia; GlaxoSmithKline(Monsanto)(#22059.18-032)LURUpdated.stockpiling,containerizing,decontaminating,treating,handling,laboratoryanalysisandultimatedispositionofanysoil,groundwaterorothermaterialssuspectedorconfirmedtobecontaminatedwithregulatedsubstances;ande.removalofanycontaminatedsoil,waterorothercontaminatedmaterials(forexample,concrete,demolitiondebris)fromtheBrownfieldsProperty(copiesofalllegallyrequiredmanifestsshallbeincluded).IncomplianceElOutofcomplianceRemarks:A2020AnnualRedevelopmentSummaryReportiscurrentlybeingpreparedbyH&HforsubmittaltoDEOBrownfields.LUR10:NeitherDEQ,noranypartyconductingenvironmentalassessment,remediation,orinspectionattheBrownfieldsPropertyatthedirectionof,orpursuanttoapermit,orderoragreementissuedorenteredintobyDEQ,maybedeniedaccesstotheBrownfieldsPropertyforpurposesofconductingsuchassessment,remediation,orinspectionwhichistobeconductedusingreasonableeffortstominimizeinterferencewithauthorizedusesoftheBrownfieldsProperty.IncomplianceElOutofcomplianceRemarks:LUR11:AnydeedorotherinstrumentconveyinganinterestintheBrownfieldsPropertyshallcontainthefollowingnotice:“ThispropertyissubjecttotheBrownfieldsAgreementattachedasExhibitAtotheNoticeofBrownfieldsPropertyrecordedintheDurhamCountylandrecords,Book9014,Page228.”AcopyofanysuchinstrumentshallbesenttothepersonslistedinSectionXV(NoticesandSubmissions),thoughfinancialfiguresandotherconfidentialinformationrelatedtotheconveyancemayberedactedtotheextentsaidredactionscomplywiththeconfidentialityandtradesecretprovisionsoftheNorthCarolinaPublicRecordsLaw.Theownermayusethefollowingmechanismstocomplywiththeobligationsofthissubparagraph:(i)Ifeveryleaseandriderisidenticalinform,theownerconveyinganinterestmayprovideDEQwithcopiesofaformleaseorriderevidencingcompliancewiththissubparagraph,inlieuofsendingcopiesofactual,executedleases,tothepersonslistedinSectionXV(NoticeandSubmissions);or(ii)Theownerconveyinganinterestmayprovideabstractsofleases,ratherthanfullcopiesofsaidleases,tothepersonslistedinSectionXV.IncomplianceElOutofcomplianceRemarks: GlaxoSmithKline(Monsanto)(#22059-18-032)LURUpdateLUR12:NoneofthecontaminantsknowntobepresentintheenvironmentalmediaattheBrownfieldsProperty,asdescribedinExhibit2oftheAgreementandasmodifiedbyDEQinwritingifadditionalcontaminantsinexcessofapplicablestandardsarediscoveredattheBrownfieldsProperty,maybeusedorstoredattheBrownfieldsPropertywithoutthepriorwrittenapprovalofDEQ,except:a.indeminimisquantitiesforcleaningandotherroutinehousekeepingandmaintenanceactivities;b.asfuelorotherfluidscustomarilyusedinvehicles,landscapingequipmentandemergencygenerators;c.ascompoundsusedinDEQ-approvedremedialactivities;ord.ascompoundsusedtosupportusesoftheBrownfieldsPropertyapprovedintheAgreementsuchthatsaidcompoundsarenotlocatedwithin100feetofasamplinglocationthathasexhibitedthosecontaminantsaboveapplicablestandardsorscreeninglevels,aslongassaidcompoundsarestoredonsolidimpervioussurfaceswithsecondarycontainmentanddistributedthroughabove-groundpipingoranyotherformofabove-groundtransfer,andaresubjecttoasite-specificspillcontrolplanpreparedbythethenowneroftheBrownfieldsPropertysuchthat,shouldareleaseofthosesubstancesoccurattheBrownfieldsProperty,thesubjectcontaminantsinthatreleasewouldbedistinguishablefromthesubjectcontaminantsinanyknownreleaseattheBrownfieldsPropertythatpredatestheAgreement.IncomplianceDOutofcomplianceRemarks:LUR13:TheownerofanyportionoftheBrownfieldsPropertywhereanyexisting,orsubsequentlyinstalled,DEQ-approvedmonitoringwellisdamagedshallberesponsibleforrepairofanysuchwellstoDEQ’swrittensatisfactionandwithinatimeperiodacceptabletoDEQ,unlesscompliancewiththislanduserestrictioniswaivedinwritingbyDEQinadvance.IncomplianceDOutofcomplianceRemarks:LUR14:DuringJanuaryofeachyearaftertheyearinwhichtheNoticeisrecorded,theownerofanypartoftheBrownfieldsPropertyasofJanuary1stofthatyearshallsubmitanotarizedLandUseRestrictionsUpdate(“LURU”)toDEQ,andtothechiefpublichealthandenvironmentalofficialsofDurhamCounty,certifyingthat,asofsaidJanuary1st,theNoticeofBrownfieldsPropertycontainingtheselanduserestrictionsremainsrecordedattheDurhamCountyRegisterofDeedsofficeandthatthelanduserestrictionsarebeingcompliedwith.ThesubmittedLURUshallstatethefollowing:
