SDTF-80-04 Rowan County Dear Mr. Seth Mills & Mr. Garrett Bean: On April 20, 2021, Troy Harrison, representing the State of North Carolina, Division of Waste Management Solid Waste Section, inspected the above referenced facility for compliance with North Carolina solid waste statues and rules. The following violations were noted: 15A North Carolina Administrative Code (NCAC) 13B .0838 (a)(e) states: Each detention and treatment facility shall be designed, constructed, and maintained in such a manner as to: (1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters; Myers Septic Tank Co. was in violation of 15A NCAC 13B .0838 (a)(e) because the 5,000 Septage Detention Tank as described in Solid Waste Permit SDTF-80-04 (tank) was observed leaking waste onto the ground from the inlet valve. The above deficiency may have or can compromise the facility’s ability to ensure protection of the public health and the environment and thus require remedial action on behalf of the facility in order to maintain compliance with 15A NCAC 13B .0838 (a)(e). In order to resolve these issues, Myers Septic Tank Co. must take the following corrective actions: 1. Immediately take the necessary steps to prevent any further leakage of septage from the tank. 2. Immediately clean up all waste material on the ground that resulted from the leak. 3. Treat the area of the leak with hydrated lime. By May 14, 2021, Myers Septic Tank Co. must provide a written certification with supporting documentation on company letterhead confirming the corrective actions have been completed. Include in this certification any actions taken to prevent these deficiencies from occurring in the future. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct follow-up inspection(s) to verify that the facility has completed the requirements of this Notice of Deficiency.
