STATUS OF PERMIT: Active Issued: 3/31/2021 Expired: 2/1/2026 PURPOSE OF SITE VISIT: Routine Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 15A North Carolina Administrative Code (NCAC) 13B .0838 (a)(e) states: “Each detention and treatment facility shall be designed, constructed, and maintained in such a manner as to: (1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters;” Myers Septic Tank Co. was in violation of 15A NCAC 13B .0828 (a)(e) because the 5,000 Septage Detention Tank as described in Solid Waste Permit SDTF-80-4 was observed leaking waste onto the ground from the inlet valve. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. The permitted Septage Detention and Treatment facility consist of one 30,000-gallon, one 5,000-gallon and three 20,000-gallon above ground metal tanks for storage and treatment of domestic septage, portable toilet waste, grease trap pumping, and commercial/industrial septage. 2. The “No Trespassing” sign was in place at the entrance. 3. Vegetative growth was effectively controlled around the tanks. 4. All tanks at the facility appeared to be structurally sound with the exception of a 20,000-gallon tank; which has experienced an internal collapse (see photo below). According to the company, this tank has already been taken out of service. Any septage that remains in this tank must be removed immediately. 5. Vectors were not present at the time of inspection nor were objectionable odors observed. 6. Approved setbacks and buffers for the septage detention and treatment facility storage tanks appear to have been met. 7. The 5,000-gallon was observed with a leaking valve (see photo below). It appears that the valve has been leaking for more than a day. 15A NCAC 13B .0838 (a)(e) states: “Each detention and treatment facility shall be designed, constructed, and maintained to: (1) prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters”. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
