A complete permit review request for the next 5-year phase of operations including updated Facility, operations, and waste screening plans was due on or before 5 April 2020. This application must comply with the rules and regulations in effect at the time of the application. PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: 1) 15A NCAC 13B .0564 (9)(b) states “The facility shall meet the following minimum buffer requirements: 100 feet from the disposal area to property lines…” Unresolved. 2) 15A NCAC 13B .0566 (1) states “Operational plans shall be approved and followed as specified for the facility.” Unresolved. OBSERVED VIOLATIONS: No new violations were observed during this Facility Compliance Inspection. Please see the ADDITIONAL COMMENTS section below for details concerning the violations listed above. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 67D_INSP_20210421 Page 2 of 4 ADDITIONAL COMMENTS: 1) This Facility is a Land Clearing and Inert Debris (LCID) Landfill. 2) This Facility is recorded with the Onslow County Register of Deeds at: Book #1794; Page #169. 3) This Facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, and inert debris such as unpainted rock, brick, concrete, and concrete block. 4) This Facility is permitted to receive waste generated within Onslow County. 5) Signage is posted at the entrance to the Facility stating the Facility name, permit number, and Facility emergency contact number. 6) The Facility is secured with concrete jersey barriers and steel posts at the entrance with a steel cable locked across the access road and has controlled access for safety. 7) The Facility was closed and locked upon my arrival and no attendant was on site during this Facility Compliance Inspection. 8) Conditions were largely unchanged since the previous Facility Compliance Inspection. 9) No new disposal activities have occurred since the last Facility Compliance Inspection. 10) The Facility access road is of all-weather construction and is being maintained in overall good condition at this time. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 67D_INSP_20210421 Page 3 of 4 11) Scrap concrete, concrete block, brick, and asphalt is staged on-site in an area adjacent to the landfill for future grinding/crushing and re-use. *Please note that the State rules regarding recovered materials state that for a material to qualify as a recovered material, the majority of the material (75% or more) must be sold, used, or re-used within twelve months of staging at the site. If the required volume of materials is not re-used within twelve months, then the materials must be properly disposed at a Facility permitted to receive such wastes. 12) Soil has been stockpiled on-site for use in cover and grading operations. 13) The landfill perimeter has been staked to identify the permitted landfill disposal area and all required buffers. 14) Plans are underway for the removal of all waste from the required 100’ property line buffer. *Please continue working to ensure all waste is properly disposed inside the permitted footprint of the landfill. All waste previously disposed in the required 100’ buffer should be removed from this area and properly disposed in the permitted landfill footprint. 15) Portions of the area around the toe of the landfill have recently been mowed. *Please continue mowing around the perimeter of the landfill in order to keep the area cleared of brush and woody vegetation. This area should be maintained with unrestricted access around the entire toe of the landfill for maintenance and inspection. 16) Small trees, brush, and other woody vegetation was observed growing in many areas on the outside slopes of the landfill. *Please work to remove all brush, trees, and other woody vegetation growing within the permitted disposal boundary. Moving forward, a regular maintenance schedule needs to be instituted which should include regular mowing of the landfill and the area around the toe of the landfill to promote the growth of a healthy cover crop suitable to prevent erosion of your landfill cap system and to prevent the establishment of woody vegetation and trees in these areas. 17) Plans are underway for the re-grading of all slopes that are sloped greater than 3:1. *Please continue working to ensure that all outside slopes of the landfill are compacted, covered, and graded at a slope not greater than 3:1.
