OBSERVED VIOLATIONS: NA
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. DEMLR’s Melissa Joyner and David Powell, with Section, meet with onsite staff to inspect the NLCIDLF.
2. LF needs to establish vegetation to hold soil and reduce erosion. Most of NLCIDLF has good shape and sloping. Some sloping needs work. Some erosion rills on front and east side but good cover.
3. 50 Ft. expansion area had cover but still had some exposed waste. Soil was being staged along bottom to spread up hill. Be sure and get proper cover on waste within 30 days of receipt of the waste or when reaches one acre, whichever comes first. There was a small pile of waste atop on west end as well.

4. Edge of Waste Markers (EOW) were visible on 3 corners of the NLCID LF but one needs to be added on NW
corner. Discussions onsite were to add EOW markers for original 2-acre notification corner and then add two additional EOW markers for the 50 ft. expansion on that end of the LF. This will help staff see both limitations when inspecting onsite. Suggest keeping tall white PVC pipe. 5. DEMLR Representative, Melissa Joyner, discussed adding the 50 ft. expansion on the Sedimentation and Erosion
Control Plan (SECP), as well as the soil disturbance going to be used for cover on NW corner outside of EOW and the concrete processing area. Ground cover/silt fence was also needed, for DEMLR, on the slope and surrounding areas of the NLCID LF not being used.
6. Concrete crushing and removal is needed, although separation has begun in preparation for crushing. Stockpile has been reduced. Section staff explained 75% rule (§ 130A-309.05. Regulated wastes; certain exclusions) and the need for material to be removed otherwise it becomes disposal in previous inspection. Some unapproved waste was stockpiled, until a full load, over to side.
7. Roads should be of all-weather construction and maintained. Concrete separation and equipment driving
around side of the NLCID LF has made it difficult to get to backside of NLCID if need be with vehicles. Be sure and fix the access around the west side.

8. Ensure that during all development, operation and closure activities, side slopes do not exceed 3:1 (15A NCAC 13B .0565 (K)). Some slopes were a little steep, and needed correcting.
9. NLCID Closure and Post Closure Care rules (15A NCAC 13B .0567) were sent via email to Duncan Parker on 4/23/2021. 10. Corrective measures are necessary as a result of this inspection and should be complete within 30 days’ receipt
