Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Fields 1-4 have been harvested – the hay bales have to be removed before land application may occur on these fields. The winter cover crop on Field 5 is tall and needs harvested. Page 14 of the nutrient management plan states” Small grains will be cut and square baled in April or May. All small grain square bales will be used for roadside stabilization projects. Coastal Bermuda will be cut and round or square baled to be used for cattle feed”. Please note that a 30 day wait is required after the last septage application before the harvest of the cropstand - if the bales are to be used for livestock feed. If the above statement from the nutrient management plan does not accurately reflect how the five fields are being harvested thru the year (& how the bales are being used) please submit a signed amendment to correct the info. 2. Noted areas of vegetation other than rye/Bermuda on the fields – implement weed control this spring. 3. Noted a missing corner post on the front right side of Field 2 which needs to be reposted – the other field posts appeared adequate. It appears that the approved setbacks are being met but were not measured at this time. No sign of land application outside the permitted boundaries. No recent or heavy applications noted. 4. The required signs are posted and the access road is adequate. 5. It appears that the soil analysis that was performed at the end of 2020 did not include the required heavy metals analysis.
