PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None Page 1 of 7 NORTH CAROLINAD_E Q�� OepeNn.nf of Envlronmmbl 0w1� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The purpose of this inspection was to observe closure construction taking place at the landfill. 2. All photos included in this report were taken by Susan Heim on April 14, 2021 during the inspection. 3. Groundwater monitoring is taking place semiannually as required. Reports covering the sampling events on October 15 and November 3, 2020 and March 30-31, 2020 were reviewed and verified online. 4. An alternate source demonstration report was provided along with the October 2020 groundwater monitoring report. The assessment included a recommendation for the installation of a new background monitoring well and of an additional downgradient assessment monitoring well. The installation of these two new wells was approved by Christin Ritter, Solid Waste Section Hydrogeologist in an email dated October 28, 2020. Mr. Winegar confirmed that both new wells had been installed at the facility as approved. No inspection of monitoring wells occurred during this inspection due to the inaccessibility of most areas surrounding the landfill footprint. 5. Site plans and erosion control plans were reviewed onsite prior to inspecting the landfill. Mr. Prater explained that his company is currently working to complete the installation of the erosion control measures for the site, which include three large sediment basins. 6. The location of waste previously documented as being outside of the landfill footprint was discussed, specifically in the area to the west of the landfill, including the access roadway; and the area to the north of the landfill, where slope failure had forced waste out of the disposal area, down the slope, and into the flat land adjacent to the creek. Mr. Prater stated that he would be looking over the entire site for waste and, if necessary, could use equipment already onsite to collect it and return it to the landfill for proper disposal. 7. Mr. Prater stated that a ditch is being constructed at the toe of the slope along the southern and western sides of the landfill for the purpose of directing storm water. He added that, as the ditch is excavated, equipment operators will be able to identify the waste boundary. 8. Mr. Prater stated that his company's contract with OmniSource requires completion of the project by September 2021, adding that he anticipated having to adjust that date based on the weather delays that had already occurred. Field Inspection: 9. The landfill was approached on foot from the scrap yard to the south. 10. Equipment operators were observed working on the construction of a sediment basin located at the southeast corner of the landfill. A large portion of the eastern landfill slope had been cleared of trees in order to facilitate the basin construction and to stabilize the side slope. Several piles of trees, branches and stumps were staged on and around the landfill. Please note that open burning of wood waste is prohibited unless prior approval is obtained, as stated in 15A NCAC 13B .0505(a)(8)(A). 11. Mr. Prater stated that the wood waste resulting from site clearing and construction activities would be ground and removed from the facility and disposed of at either a permitted landfill, wood waste processing, or composting facility. Please ensure that copies of all receipts for the disposal of the wood waste are provided to the Solid Waste Section (email to susan.heimkncdenr.gov). 12. The eastern slope of the landfill was also under construction. Clean soil was observed being tracked in over the waste to reduce the grade and stabilize the slope. 13. The southern portion of the landfill was observed to be relatively flat and only a few feet above the grade of the scrap yard that abuts it to the south. 14. A second large sediment basin had been constructed at the southwest corner of the landfill. Mr. Winegar stated that the old basin is still in place beside it, but will be removed once the new basin is complete. The rough cut -in of the perimeter ditch line was visible along the toe of the western side slope. Some waste was evident in and around the ditch. Mr. Prater stated that additional excavation of the ditch line would reveal the edge of waste so that the disposal boundary could be properly identified. Please ensure that edge of waste markers are installed as required by 15A NCAC 13B .0201(g), which states that disposal area boundaries for landfills "shall be delineated with stationary markers affixed to the ground;" and that "the markers shall be of height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers are visible when standing at a marker." 16. It appeared that some work had been done to regrade the western slope of the landfill since the previous inspection in February 2020. The slope appeared to be stable but remained uncovered. Mr. Winegar stated that the closure plan calls for reducing all landfill slopes to a grade not to exceed 3:1, and that this would involve pulling all of the slopes back and ultimately making the landfill taller. 17. The access roadway leading along the western side of the landfill was of all-weather construction and maintained in good condition. However, it should be noted that, during previous inspections, waste had been observed downslope and west of the roadway and in the roadway itself. Ensure that all waste outside of the landfill footprint is collected and returned to the landfill as required by the approved closure plan. 18. At the northwest corner of the landfill, a small berm of soil had been constructed at the end of the access roadway to help slow the flow of stormwater. The third sediment basin had been constructed in this area and had encompassed and expanded the footprint of the original basin at that location. Mr. Prater stated that the entire north side of the landfill would be regraded and stabilized. He added that the approximate area where the forebay had been previously located would be graded and compacted for use as an equipment storage pad during the closure construction. 19. The north slope of the landfill was visible only from the northwest corner. However, it appeared that portions of the earthen berm and stormwater swale, constructed after the initial slope failure in September 2018, have remained in place. The large erosion rills that had been noted during previous inspections were still evident along the north slope. 20. Downslope from the waste mass on the north side of the landfill, clean soil had been used to construct a large berm across the western end and below the toe of the slope. No waste was observed in the area directly below the soil berm. However, it should be noted that waste had been observed outside of the disposal area along the entire north side of the landfill during previous inspections.
