The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Section staff inspector visited site with gate locked and no one was onsite. Attempts have been made to contact owner via email and contact number listed on YWN renewal submitted 2020. A follow up will be scheduled with owner, since making contact after inspection via email later on after inspection., to discuss inspection report and
onsite issues.
2. A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities
(Yard Waste Notifications). A review of the new rule changes would be good for anyone dealing with the YWN.
3. The renewal submitted in 2020, states that the waste onsite, “Natural Decomposition of parts of trees.” After viewing the site, its apparent a considerable amount of waste has not been removed from the site in sometime. It is not windrowed or being ground for mulch. This is essentially disposal and this area is not approved for such activity. Yard Waste Notifications (YWN) are for staging and processing. All yard waste must be processed
or removed and disposed at a site for that waste type or used to reclaim side slopes of a mine. YW cannot be given out to public unless meets 15A NCAC 13B .1406.
4. There was not a large volume onsite during inspection but a good amount that needs removal or processing. At this point a large amount of the waste currently onsite should be utilized or removed to catch up. Any unapproved waste discovered during removal or processing should be disposed of at a site for that waste type.
5. Inspector reviewed the Moore county tax map and satellite map for site to see about property lines and buffers after inspection. Currently some of the waste seems very close or within a buffer on the NLCID N0285 in the
back. It was hard to tell if waste was beyond what was visible in the open area. If there is YW beyond the 2 acres, it will need to be pulled back inside the 2-acre footprint and should be removed and utilized according to rule or disposed of at landfill for that waste type.

6. Notified Land Clearing and Inert Debris rules have recently changed and may affect the N0285. Inspector will address those issues in the follow up inspection after conversing with management on the implementation of the new rules which may affect this site. For reference the rules are: 15A NCAC 13B .0563 - .0567.
7. While onsite there was a small pile of YW in an area which had been burned in the past. Please note, the burning of solid waste is prohibited.
15A NCAC 13B .1406 (7) Safety Requirements. (a) Open burning of solid waste shall be prohibited. (b) Equipment shall be provided to control accidental fires and arrangements made with the local fire protection agency to provide fire-fighting services when needed. (c) Personnel training shall be provided to ensure that all employees are trained in site specific safety, remedial, and corrective action procedures. (8) Reporting Fires. Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the incident.

8. Currently there is a good amount of YW that needs removal or processing. Mr. Powell is willing to work with owner, just please communicate well and make progress towards fixing the issues onsite.
9. Currently, a sign at the entrance is required according to 15A NCAC 13B .1406 (9) if site is open to the public.
10. Corrective measures are necessary as result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff to meet onsite with owner. Failure to meet the conditions for compliance may result in Compliance Actions. If the owner doesn’t process/remove all the current waste at this facility in a timely manner, then the site should be compliant with all of the 15A NCAC 13B .1400 rules for Small Type 1 Compost facilities (Yard Waste Notifications).
