STATUS OF PERMIT:
Active; Life of Site Permit to Operate (PTO) issued 26 February 2019. This permit shall expire 7 October 2053.
Pursuant to NCGS 130A-295.8, the permitee must submit a permit application for any change to the approved
engineering plans or for a substantial amendment to the permit. An application for a permit must be prepared in
accordance with all applicable statutes and rules in effect on that date.
PURPOSE OF SITE VISIT:
Partial Facility Compliance Inspection without records review
STATUS OF PAST NOTED VIOLATIONS:
1) 15A NCAC 13B .0104 (a) states “The owner or occupant of any property, except that exempted as specified
in Rule .0103(c) of this Subchapter shall be responsible for the sanitary storage of all solid waste accumulated
on the property.” Unresolved
2) 15A NCAC 13B .0104 (b) states “Garbage shall be stored in either durable rust resistant, non-absorbent,
water-tight, rodent proof, and easily cleanable containers with a close fitting fly-tight cover, when applicable, or
other types of containers acceptable to the local governing agency and conforming to the intent of this Section.”
Resolved
3) 15A NCAC 13B .0104 (c) states “Refuse shall be stored in durable containers or as otherwise provided in this
Section. Where garbage is stored in combination with refuse, containers shall meet the requirements for garbage
containers.” Resolved

4) 15A NCAC 13B .0104 (e) states “All containers for the storage of solid waste shall be maintained in such a
manner as to prevent the creation of a nuisance or insanitary conditions. Containers that are broken or otherwise
fail to meet this Rule shall be replaced with acceptable containers…” Resolved
5) 15A NCAC 13B .0104 (f) states “All solid waste shall be stored in such a manner as to prevent the creation
of a nuisance, insanitary conditions, or a potential public health hazard.” Resolved
6) 15A NCAC 13B .0402 (1) states “Operational plans shall be approved and followed as specified for the
facility.” Unresolved
7) 15A NCAC 13B .0402 (7) states “Appropriate method shall be provided to confine material subject to be
blown by the wind within the area. At the conclusion of each day of operation, all windblown material
resulting from the operation shall be collected and returned to the area by the owner or operator.” Unresolved
OBSERVED VIOLATIONS:
1) 15A NCAC 13B .0104 (a) states “The owner or occupant of any property, except that exempted as specified
in Rule .0103(c) of this Subchapter shall be responsible for the sanitary storage of all solid waste accumulated
on the property.”
2) 15A NCAC 13B .0402 (1) states “Operational plans shall be approved and followed as specified for the
facility.”
3) 15A NCAC 13B .0402 (7) states “Appropriate method shall be provided to confine material subject to be
blown by the wind within the area. At the conclusion of each day of operation, all windblown material
resulting from the operation shall be collected and returned to the area by the owner or operator.”
Please see the ADDITIONAL COMMENTS section below for details concerning the violations listed above.
ADDITIONAL COMMENTS:
1) This is a Solid Waste Transfer Facility and is permitted to receive Solid Waste as defined in NCGS 130A-
290(a)(35).
2) Hazardous waste, yard trash, liquid wastes, regulated medical waste, sharps not properly packaged, regulated
asbestos containing material as defined in 40 CFR 61, PCB waste as defined in 40 CFR 761, infectious waste,
animal carcasses, radioactive waste, septage, fluorescent and high-intensity discharged lamps,
ashes/incinerated residues, and wastes banned from disposal in North Carolina by NCGS 130A-309.10(f) are
prohibited from being accepted at this Facility.
3) This Facility is permitted to receive Municipal Solid Waste, Construction & Demolition Waste, Scrap Tires,
and Yard Waste generated in Carteret, Craven, and Pamlico Counties.
4) All waste, with the exception of scrap tires, which are hauled directly to Central Carolina Tire, permit #43-04
in Cameron NC, is transported to the Coastal Environmental Partnership Subtitle-D Landfill, permit #25-09 in
Tuscarora, Craven County, NC.
5) Proper signage including the Facility permit number, accepted waste types, banned or excluded items, hours
of operation, and the emergency contact number is posted at the facility entrance.
6) The hours of operation are Monday through Friday 7:30 AM to 4:30 PM and Saturday 7:30 AM to 12:00 PM.
7) The Facility is secured by means of a locked gate at the Facility entrance.
8) The Facility access road is of all-weather construction and is being maintained in overall good condition.
9) This Facility maintains an adequate number of trailers on site to properly manage the volume of waste
received during operating hours.
10) Access around the Facility is generally stable with a healthy cover crop of warm season grasses suitable to
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

prevent erosion.
11) A large volume of Construction and Demolition (C&D) waste was observed in the C&D Loading area and no
trailers were present in the C&D loading bays during this Facility Compliance Inspection. All incoming C&D
waste should be maintained on the concrete tipping floor until placed into waste hauling trailers.
12) Overflow waste was observed collected in and around the C&D loading bay. This area does not appear to be
being cleaned daily as required. *Please ensure that this area cleaned of overflow waste at the end of each
workday or more often throughout the workday if necessary.
13) Overflow/windblown debris was observed collected against the inside and outside of the concrete jersey
barriers lining the paved turnaround areas. These areas do not appear to be being cleaned daily as required.
*Please ensure that all windblown and overflow debris is collected and properly disposed at the end of each
workday.

14) Overflow/windblown debris was observed collected along the access/exit ramps. These areas do not appear to
be being cleaned daily as required. *Please ensure that all windblown and overflow debris is collected and
properly disposed at the end of each workday.
15) *The interior walls of the Facility and the trailer loading bay are in need of cleaning/pressure washing.
16) Due to the volume of waste present in the transfer station the tipping floor could not be reviewed during this
Facility Compliance Inspection.
17) The waste type waste reviewed. No unpermitted wastes were observed during this Facility Compliance
Inspection.
18) *Please ensure the trailer loading area is cleaned of any waste overflow as trailers are removed from the bays
for transfer and at the end of the workday.

19) The leachate collection drain in the trailer loading area appears to be functioning properly.
20) Scrap tires are collected throughout the week and placed into trailers for direct haul to the Tire Management
Facility every Saturday after shutdown. *Please ensure that all scrap tires are collected and properly managed
in a timely manner. All whole scrap tires or partial scrap tires capable of holding water that will be stored
onsite for more than ten days must be tarped/covered upon receipt.
21) Leachate is collected on-site in an above ground storage tank and is pumped down and hauled for treatment as
needed. The leachate collection/storage system appears well maintained and properly managed at this time.
22) The area around the secondary scale was clear of overflow debris and appears well maintained at this time.
23) Yard waste is collected on site and staged for transport to the Coastal Environmental Partnership Compost
Facility, permit #25-09, in Craven County for composting.
24) The vegetative waste staged in the Yard Waste Management Area has recently been processed and the ground
material is in the process of being transported to the Coastal Environmental Partnership for composting.

25) Fencing has been installed at the Yard Waste Management Area along the property boundary to control wind
blown debris.
26) *Corrective measures are required as a result of this Facility Compliance Inspection Report.
