STATUS OF PERMIT: Yard Waste Facility Notification application received by SWS on May 29, 2020 Yard Waste Facility Notification expires on June 1st each year PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS On April 15, 2021, Chuck Kirchner met with Will Copeland to conduct a comprehensive inspection of the Apex Nurseries, Inc. YWN Site No. 1 facility located off of NC HWY 751 at Apex Nurseries in Apex, Chatham County. 1. The yard waste notification (YWN) is operated by Apex Nurseries, Inc. It is known as YWN Site No. 1. 2. Apex Nurseries, Inc. operates an additional YWN on an adjacent parcel of land, No. 19-007 YWN Site No. 2. 3. The facility is open to the public. 4. The facility grinds land clearing debris (LCD) and yard waste. 5. The facility also grinds material for boil fuel. 6. The facility does not compost material. 7. No yard trash was observed on site. 8. Throughput records were observed from June 3, 2019 through April 15, 2021. 9. The YWN has ~ 300 yd3 of material on site. 10. Unprocessed and processed material for boiler fuel shall be maintained separately from unprocessed and processed material for mulch. 11. Open burning of waste is prohibited. 12. Fires shall be reported to the division orally within 24 hours of the incident and in writing within 15 days of the incident. 13. Ensure a 50-foot buffer is maintained around the YWN designated area. 14. No erosion or runoff was observed. 15. Apex Nurseries, Inc. stores logs for firewood and accepts ground mulch for sale to the public. The firewood and purchased mulch storage areas are located adjacent to the YWN designated area. 16. Apex Nurseries, Inc. also purchases logs to cut into lumber. 17. Access roads into the facility are gravel. 18. The facility has a proper sign. 19. The Yard Waste Notification expires on June 1st each year. Continue to submit a YWN application annually prior to June 1st to keep site active as discussed in the field. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
