STATUS OF PERMIT: Active Issued: 1/29/2021 Expires: 1/29/2026 PURPOSE OF SITE VISIT: Complaint Investigation STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: N/A The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The permitted facility consists of four 18,000-gallon and one 36,000-gallon in ground concrete tanks with a total capacity of 108,000 gallons for the storage of untreated and treated septage. Also observed was a dewatering box. 2. On March 31, 2021, the I (Troy Harrison, Environmental Specialist II) received a complaint from the Lincoln County Health Department concerning a possible septage spill from A Sani-Can (a solid waste/septage management company). Based on a citizen complaint, Lincoln County Emergency Management had conducted an initial investigation on March 27, 2021. The Lincoln County Health Department conducted a follow-up investigation on March 29, 2021. 3. A response to the complaint from Neely Robinson of A Sani-Can was received on April 1, 2021. 4. On March 31, 2021, I contacted Lauren McAlister via telephone at A Sani-Can. She stated that she was aware of the complaint. Mr. Gary Dellinger contacted me via telephone concerning the complaint. 5. On April 5, 2021, I went to the site to conduct an investigation. Mr. Dellinger was present during the investigation. The facility is permitted for the storage and treatment of grease trap pumpings and is located at 7840 Webbs Road, Denver, Lincoln County. Other activity at this location included storage and maintenance of portable toilets and septage hauling vehicles. McClintock Road runs to the immediate south of the facility and leads to a residential development. The topography generally slopes in a southern direction. Several heavy rain events appear to have occurred in the last several days. No surface run-off was observed during the investigation; however, previous storm water evidence was observed in the area between McClintock Road and the facility. The source of the runoff from was traced back to the southwestern corner of the property occupied by A Sani-Can. The solid waste section does not regulate storm water runoff. At the time of the investigation, portable toilets were being serviced in the northwestern portion of the property. No leaks were observed from the permitted detention tanks, septage hauling vehicles or portable toilets. The de-watering tank was not at the facility during the investigation. No violations were observed during the investigation. 6. No objectionable odors were observed.
