Transylvania County conducted and submitted the soil sampling as required by the September 1, 2020 Inspection Report. An email stating no further action is required at this time was sent by Christine Ritter, Hydrogeologist, Solid Waste Section on Monday, December 14, 2020. OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on April 8, 2021. 2. The facility is open Monday through Saturday, 8:00am to 4:00pm. 3. The required signage was observed at the entrance of the facility and the scale house. Additional directional and informational signage is posted throughout the facility to aid customers. 4. The facility is secured by gates at both entrances and a portion of the facility is fenced to prevent unauthorized access. In areas where fencing has not been installed, topography serves to limit access as well. Records Review 5. Tonnage records were provided by email. The facility has disposed of 21,400 tons of material from July 1, 2020 to April 6, 2021. 6. Semi-annual groundwater monitoring was conducted on April 22-23, 2020, July 30, 2020, October 20-21, 2020 and January 4, 2021 and the results were submitted to the section and are available for review on Laserfiche document management system. 7. Landfill gas monitoring data was provided by email for review. Records indicate that sampling was conducted on April 23, 2020, September 9, 2020, October 20, 2020 and January 4, 2021, as required, and no exceedances were reported. Operations Inspection of the MSWLF Unit (8807-MSWLF-1990) 8. The facility recently reworked the west slope of Phase 1. During this "slope recovery" they were able to recover nine months of airspace that was previously occupied by soil. 9. A small amount of windblown material was observed in the unused portion of Phase 5. As stated in 15A NCAC 13B .1626 11(c): "At the conclusion of each day of operation, all windblown material resulting from the operation shall be collected and returned to the area by the owner or operator." Collect and return all windblown material at the end of each working day. 10. The working face was of manageable size, compact and no banned waste was observed. 11. Several scrap tires and white goods/scrap metal had been pulled from the working face and set aside for proper disposal. 12. An area of exposed waste was observed to the north of the slope recovery area. Facility staff were observed applying additional cover to this area at the time of inspection. 13. To comply with 15A NCAC 13B .0208(a)(1), the facility has staged roll off containers on the east side of the lined portion of the landfill for business waste. These containers are emptied at the end of each working day. This use was discussed with Allen Gaither, Permit Engineer, and verbally approved with the provision that adequate cover is maintained in the area. 14. The access roads were constructed of all-weather material and were well maintained. Other Comments 15. The leachate tank was inspected and the secondary containment valve was closed. 16. The wood waste stockpile is located to the east of Phase 5. Two cabinet doors were observed in the stockpile from what appeared to be a recently dumped load. Two scrap tire trailers are located to the east of the scale house. The area was well maintained and all tires were stored in the trailer.
