Alma Street Vass, NC 28394 PARTICIPANTS: David Powell, SWS Timothy Brewer, Town of Vass STATUS OF PERMIT: Yard Waste Notified 2012 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: N/A The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Section staff inspector visited site on previous day, 3/30/2021 but gate was locked. Inspector contacted Town of Vass morning of 3/31/2021, beforehand, to have gate open. Road access was good. 2. A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for Town staff dealing with the YWN. 3. The renewal submitted in 2020, states that the waste onsite will “compost and wood chips used at town park and flower beds.” After discussing with Mr. Brewer and viewing the site, its apparent most waste has not been removed from the site in sometime. It is not windrowed or being ground for mulch. It is dumped and pushed into edges of the cleared out area. This is essentially disposal and this site is not approved for such activity. Yard Waste Notifications (YWN) are for staging and processing. All yard waste must be processed or removed and disposed at a site for that waste type. There was also some unapproved waste between entrance road and east property line, including painted lumber, bricks and block (C and D) and other comingled waste that is not considered yard waste. Please remove and provide documentation of disposal of these wastes at the appropriate landfill for that waste type. These pictures are along the entrance road on east side near property line. Waste is within buffer and not approved for Yard Waste Notification. 5. There was not a large volume onsite during inspection. Inspector reviewed the Moore county tax map and satellite map for site to see about property lines and buffers after inspection. Currently some of the waste seems very close or within a buffer along edges of the sides closest to the entrance. Small Type 1 should have a 50-foot buffer from property lines. This waste needs to be removed from the buffer areas. The issues are that the waste is pushed closer, all around, to the property lines on this small parcel. Remember, it is supposed to be less than 2 acres total, which it seems to be currently. It was hard to tell if waste was beyond what was visible in the open area. If there is YW beyond the 2 acres, it will need to be pulled back inside the 2-acre footprint and should be removed and utilized according to rule or disposed of at landfill for that waste type. Onsite discussions included the need for additional equipment and people to do work onsite that is needed to operate the YWN in compliance. It was also discussed, that it may be simpler for the Town to pick up the YW and take it directly to an approved disposal site and stop using the YWN. Currently there is a good amount of YW that needs removal or processing. YW cannot be given out to public unless meets 15A NCAC 13B .1406. That means, in part, that time and temperature records will need to be kept after grinding and windrowing, along with occasionally turning. Any unapproved waste discovered during removal or processing should be disposed of at a site for that waste type. Mr. Powell and Mr. Brewer discussed loading and removing material with the Towns current equipment, although it may not be the easiest task, it should not be too large of one to undertake and get site back into compliance. Mr. Powell is willing to work with Town moving forward, on which ever path they choose, just please communicate well and make progress towards fixing the issues onsite. 7. Currently, a sign at the entrance is required according to 15A NCAC 13B .1406 (9). A soil pad should be prepared in accordance with 15A NCAC 13B .1404 if going to process the yard waste onsite or in future. 8. Mr. Powell emailed 15A NCAC 13B .1404, .1406 rules to towns email address and Ms. Mabel Walden for review. 9. Please keep copies of all documentation, load volumes and where the waste goes etc., and submit to Waste Management. 10. Corrective measures are necessary as result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff in about 60 days. Failure to meet the conditions for compliance may result in Compliance Actions. Keep in mind if the Town doesn’t wish to close, there are other issues that will need addressing to keep and operate it as a yard waste notification. For example, time and temperature records must be recorded and the site could not have more than 6,000 cubic yards onsite at any one time. If the City doesn’t remove all the current waste at this facility in a timely manner, then the site should be compliant with all of the 15A NCAC 13B .1400 rules for Small Type 1 Compost facilities (Yard Waste Notifications).
