The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Section staff contacted NCDOT Josh Brooks beforehand to have gate open. Road access was good. A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1406 rules for Small Type 1 Compost facilities (Yard Waste Notifications).
2. Renewal submitted in 2020, states that the waste onsite will be mulched and used as shoulder material and beautification purposes. Site is used by NCDOT.
3. During inspection, the site had an estimated 2,000 to 3,000 cubic yards of combined ground yard waste and unground yard waste. On one side, was a large pile of ground waste with a pile waiting to be ground beside it. Windrows had good separation and access, good job. In the back were two smaller windrows of ground waste and another pile staged for grinding.
4. A very small amount of unapproved waste was visible, comingled in the waste waiting for grinding. A roadside political sign, glass bottle, dimensional treated lumber etc. Be sure to remove and dispose of at proper permitted site for that waste type.

5. Stockpiles were placed on well sloped soil. This is good, but leachate was visible soaking down gradient to the
access road. Be sure leachate doesn’t discharge and use best management practices with managing and containing onsite. 15A NCAC 13B .1404 Rule states, “shall not contravene groundwater standards as set forth in 15A NCAC 02L.”
6. Just as a reminder, the 75% rule, § 130A-309.05. Regulated wastes; certain exclusions, for the concrete waste
onsite. Basically says, 75% of what’s taken in should be gone within a calendar year.
